MINUTES OF THE REGULAR MEETING OF THE TOWN OF ELLICOTT PLANNING BOARD HELD AT THE ADMINISTRATION BUILDING, 215 SOUTH WORK ST., FALCONER, NY ON MAY 16, 2001 AT 7:00 P.M.

 

PRESENT:  Chairman Dan Evans, Ron Calanni, Becky Goodell, Dave Carlberg, and Attorney

ABSENT:    Gary Swanson, Bob Pickett and Pat McLaughlin

 

Motion made by Dave Carlberg, seconded by Ron Calanni to approve the minutes of the April 11, 2001 meeting.

No one was present for the site plan revisions on the State Police barracks on North Main Street Ext., Jamestown, NY. Attorney Wright said he would recommend that the Code Enforcement Officer start enforcement action against the applicant since they have not complied with the approved site plan and have made no attempt to rectify the situation.  Since Mr. Woodbury was out of Town he would suggest the Board table this until the next meeting.

 

Motion made by Ron Calanni, seconded by Dave Carlberg to table the State Police revisions until the June meeting.

B & L Realty NY LLC was to present site plans for a new commercial building on their property on Strunk Road.  Attorney Wright explained they have requested to present their site plans after they have a decision on the set back variance that is  before the Zoning Board of Appeals.

 

Gene Aversa and Todd Patric were to present findings for their sub-division on West Oak Hill Rd. Jamestown, NY.  Attorney Wright met with the applicant and they have requested that the Planning Board put this project on hold until the can resolve the sewer and water issues.

 

No one was present for the site plans for George Means for his building at 3200 Terminal Drvie to be used as a limousine business.

 

Motion made by Dave Carlberg, seconded by Ron Calanni to table the application of George Means for a limousine business at 3200 Terminal Drive, Jamestown, NY.

Dale Anderson from Dale Anderson Masonry did not have completed plans for the car wash project at the Chautauqua County Airport.  He thought that the airport was preparing site plans.

Charlie Hodges, Chautauqua County Airport, explained they were waiting for the applicant to provide dimensions for the project.  They still have not completed their process.  This car wash will be for Hertz Rental cars only. 

 

Motion made by Ron Calanni, seconded by Dave Carlberg to table this applicant until the site plans are completed.

John Cusimano reviewed the plans for the addition to his business at 2597 South Work Street, Falconer, NY.  Discussion followed between the Board members and Mr. Cusimano. His plans were not complete but the Board decided to review the check list and list the items that Mr. Cusimano needed to provide.

 

The Board reviewed the site plan checklist noting:         

 

1)      the applicant needed to get an architect seal

2)      the dimensions were not on the plans or the set backs – discussion if Mr. Cusimano would need to get a variance for the back yard set back

3)      topography  was waived by the Planning Board

4)      the Board waived the bituminous surface on the parking area because there is a septic system under that area

5)      fence and retaining wall are shown on the plans

6)      no new signs

7)      outdoor lighting will be security lights on the building

8)      ground cover is already existing

9)      no retail sales

10)  projected schedule  - owner would like project completed by winter

11)  adjoining neighbors need to be shown on the plans

 

The items that were missing from the plans and that need to be provided by Mr. Cusimano:

 

1)      the architect seal

2)      the dimensions of the building and set backs

3)      the outdoor lighting to be shown on the plans

4)      the plans needed to show the adjoining property owners


Merle Przbelinski, 2605 South Work St., Falconer, NY, had no objection to this project but had concerns about the trees along the property line.  Mr. Cusimano will meet with him and resolve any concerns he has.

Mr. Cusimano will decide if he wants to request a variance from the Zoning Board of Appeals for his back yard setback or if he will change his plans.  He will bring the site plans with the missing items to the June meeting.

 

Mr. George Means apologized to the Board for being late.  He presented his plan to change the use of the building he owns at 3200 Terminal Drive, Jamestown, NY to a limousine business. Dave Daversa, owner of Fancee Limousine, will be purchasing the property and running his business out of that location.

 

Attorney Wright explained there is no problem in the zoning of the property because the zoning was changed in 1986.  Councilman Hendrickson had research the change and found out that it just had been omitted from the code book.

 

Mr. Means had vacated this property more than a year ago so the Planning Board determined that they had to have a site plan.  Mr. Means could find the plans from when he purchased the property and revised them or have a new site plan completed.

 

Mr. Daversa stated that they would not  be doing any maintenance at this location only the washing of the cars.  

 

Mr. Hodges said that the airport’s concerns would be addressed with the driveway permit lease the applicant will have with the airport.

 

Mr. Hodges had some questions on the location of the Aversa and Patric sub-division.  He also asked if the airport could be notified of any cell tower projects and locations that come before the Town.

 

Motion made by Ron Calanni, seconded by Dave Carlberg to adjourn the meeting at 8:10 P.M.
