MINUTES OF THE REGULAR MEETING OF THE TOWN OF ELLICOTT PLANNING BOARD HELD AT THE ADMINISTRATION BUILDING, 215 SOUTH WORK STREET, FALCONER, NY ON MARCH 14, 2001 AT 7:00 P.M.

 

Present: Chairman Dan Evans, Gary Swanson, Ron Calanni, Becky Goodell, Patrick McLaughlin, Attorney

                William Wright and Code Enforcement Officer Randy Woodbury

 

Absent:  Bob Pickett and David Carlberg

 

Chairman Evans called the meeting to order at 7:00 P.M.

 

Motion made by Ron Calanni, seconded by Gary Swanson, to approve the minutes of the February 21, 2001 meeting.

Chairman Evans asked Code Enforcement Officer Randy Woodbury to brief the Board on the status of the Buffalo Lube site plan.  Mr. Woodbury told the Board that he had not heard from them and understood that the property was for sale again.

 

Pat McLaughlin made a motion, seconded by Ron Calanni to dismiss the request for the Buffalo Lube site plan for property on Fairmount Ave., W.E., Jamestown, NY.

Mr. Woodbury briefed the Board members on the revisions on the site plan for Mr. Cerrone for the State Police station on N. Main St. Ext., Jamestown, NY. He explained that Mr. Cerrone required a variance from the State on fire and building codes and they would be in Buffalo for that on Tuesday. He had talked to both Mr. Cerrone and the State Police and thought they would be in to the Planning Board after the State variance was resolved.  Mr. Woodbury said the certificate of occupancy was temporary and they had to be in compliance before 3/31/01. He feels that he can get the tenant to comply if not the developer. There was discussion on the zoning issue of parking in the front of properties on North Main Street.

 

Mr. Woodbury told the Board that Timothy and Janet Miller had delays with their survey and site plan and would not be presenting them until next month.

 

Mr. Woodbury briefed the Board about the site plan for Kenneth and Patricia Strong.  They still have issues with the Zoning Board and have to resolve those before they come before the Planning Board. It will also have to be decided if they will have to be considered by the Planning Board.

 

Richard Moon, Pharmacist, and David Rhinehart, Habiterra Associaties, presented site plans to construct a new building for commercial and office use at 857 Fairmount Ave., W.E., Jamestown, NY.

 

The building will be 4100 square feet and house Southern Tier Home Pharmacy.  The entrance will be off Wellman and there will be parking in the front for customers and in the rear for the employees. The existing house will be demolished but the garage will stay.

 

Discussion followed between the Board, Mr. Moon and Mr. Rhinehart on:

1)      water drainage-concerns with the drainage onto Wellman which will go into the State system on Fairmount

2)      paving-need time to settle before paving

3)      foundation-slab with no basement

4)      lighting-directional mounted on the building

5)      sewer easement

6)      set backs-in mercantile there are set backs for the building only not the parking lot

7)      parking spaces

8)      hours of operation-9:00 AM to 6:00 PM Monday through Friday and 9:00 AM through 2:00 PM on Saturdays

9)      landscaping

 

Attorney Wright asked about the drainage into the State system on Fairmount Ave. This Board has been told that the State will not accept any more drainage into their system.

 

The Board continued by reviewing the site plan checklist noting:

 

1)      applicant needs to provide drainage calculations and plans

2)      Planning Board required that the paving be done within a certain period of time

3)      signage was discussed

4)      planting schedule needs to be provided

5)      buffered areas and green space were discussed

6)      construction will start in the Spring and be completed in 90 days

 

Attorney Wright told the Board members that this project is subject to environmental review because of the total square footage.  He stated that this proposed project does not exceed any Type I thresholds in 6 NYCRR, part 617.4 and will not received any coordinated review.

 

The Board members continued with Part IIC of the EAF and noted there would be no regulated waste and no outside dumpsters.  The parcel is zoned mercantile and has City utilities.

 

Motion made by Pat McLaughlin, seconded by Gary Swanson to have Chairman Evans check the box in Part III that states that the Planning Board has determined that this proposed project will not result in any significant environmental impacts and have him sign on behalf of the Board.

Motion made by Pat McLaughlin, seconded by Ron Calanni to approve this site plan for Richard and Kelly Moon to construct a new commercial building at 857 Fairmount Ave., W.E., Jamestown, NY with the following contingencies:

1)      applicant must submit a planting schedule to the Code Enforcement Officer for approval

2)       buffered area needs to be changed so that the parking lot is held 20 feet off the easterly property line

3)      applicant must submit drainage plan and calculations (with the size of the pipe and flow onto Wellman) for the approval of the Town Engineer

4)      paving of the parking lot must be completed by 07/01/2003

Pat McLaughlin stated the applicant should notify Chautauqua Lake Sewer District if they are paving over the sewer easement.

Jim Senger, Vice President of Real Estate, and Christopher Mack, Real Estate Director for United Refining Company of PA presented site plans for a new modular building on 700 Fairmount Ave. W.E., Jamestown, NY.  They had been approved for a site plan presented in March of 1999 but had not completed the project.

 

Attorney Wright informed the Board members that there were zoning issues with this proposed project and the applicant would have to go before the Zoning Board of Appeals.  They will require a variance for the set back of the canopy and the sign. He explained that the Planning Board had the option of waiting for the ZBA approval or could approve the site plan contingent on the approval of the ZBA.

 

The Board agreed to go over the site plan and if possible they would approve contingent on the approval of the Zoning Board of Appeals.

 

Discussion followed between the Board, Mr. Senger and Mr. Mack.  The modular will be 432 square feet and would replace the existing building.  It will be set on a new permanent foundation. 

 

Going over the site plan checklist the Board noted:

1)      the drainage will not change

2)      tanks will be the same – they will eliminate  one diesel tank

3)      no outdoor storage

4)      location of fire hydrants

5)      signage – ZBA approval is required

6)      lighting will be underneath

7)      hours of operation will be 6:00 AM to 12:00 AM

8)      landscaping will remain the same

9)      project will be completed 90 days after the start of construction

10)  foundation will be a permanent slab

 

Attorney Wright stated this proposed project does not required environmental review under NYCRR 617.5 (C) (7) as a non-residential structure less than 4000 square feet.

 

Motion made by Pat McLaughlin, seconded by Ron Calanni to approve the site plan for United Refining Company of PA for the modular building at 700 Fairmount Ave., W.E., Jamestown, NY contingent on the approval of the Zoning Board of Appeals for their variance for their setback and sign.
