MINUTES OF THE REGULAR MEETING OF THE TOWN OF ELLICOTT PLANNING BOARD HELD AT THE ADMINISTRATION BUILDING, 215 SOUTH WORK ST., FALCONER, NY ON JANUARY 9, 2002 AT 7:00 P.M.

 

PRESENT:  Chairman Dan Evans, Ron Calanni, Bob Pickett, David Carlberg, Attorney

                      William Wright and Code Enforcement Officer Randy Woodbury.

 

ABSENT: Becky Goodell and Gary Swanson

 

Chairman Evans called the meeting to order at 7:00 P.M.

 

Motion made by Dave Carlberg, seconded by Ron Calanni to approve the minutes of the November 14, 2001 meeting.

 

S. Richard Piazza and his engineer, Jerry Erickson, P.E., presented plans for Stone Mountain Carpet Outlet to be located on property owned by Mary Ellen Williams at 878 Fairmount Ave., W.E., Jamestown, NY. 

 

Mr. Erickson briefed the Board members on the project. The existing structures will be removed and the property re-graded.  A new 12,500 square foot building will be constructed to house a carpet outlet store. The applicant will be using about 2/3 of the property. 

 

Discussion followed on the possible wetlands on this property. It was determined that there were no designated wetlands on the property. Significant fill will be needed for this project.

 

The building will be 100’ x 125’ but there were no building elevations on the plans. The Board said they would accepted building plans from the contractor if Mr. Piazza had them.

 

Chairman Evans was concerned about the parking spaces in the front along Fairmount Avenue. There were four spaces shown on the plans that were not 15 feet back from the property line. The Board agreed they would like those spaces relocated  or eliminated. Mr. Erickson and Mr. Piazza stated they did not need the spaces and would eliminate them. 

 

Discussion followed on:

            1) the access onto Fairmount Avenue

            2) the easement with Dairy Queen for the drainage

            3) loading and unloading

            4) lighting

            5) deliveries

            6) hours of operation

            7) amount of fill

            8) construction schedule

Mr. Woodbury told the Board he had spoke to Highway Superintendent Shellhouse about the drainage. Mr. Shellhouse would like the Planning Board to require that the drainage calculations be reviewed by the Town engineer. Mr. Woodbury reminded the applicant that he would be responsible for the town engineer fees.

 

Bruce Turner, Realtor, stated that the Town of Ellicott is the only Town that requires a review by a Town engineer and he did not think the applicant should be responsible for the cost nor should the Board question the applicant’s engineer.

 

Attorney Wright was concerned about the amount of fill and  asked about the construction schedule. He asked if a normal silt fence would be adequate for this project and if they would be disturbing the creek. The projected construction schedule will be April to May and the applicant would not be waiting until fill was available to complete this project.  Attorney Wright stated he thought the Town needed a time commitment. 

 

Mr. & Mrs. Bruce Peterson, 11 Jackson Avenue W.E., Jamestown, NY, addressed the Board with concerns about their privacy. They asked if the applicant would be willing to put up  a privacy fence.

 

Discussion followed between the Petersons, Mr. Piazza and the Board members. Everyone seemed to agree that a fence was not feasible because it would be hard to maintain. It would be better if the applicant would put up arborvitae.  It was decided that the applicant will meet with the Petersons and come up with something that Mr. Erickson can show on the new plans. 

 

The Board members felt there were to many contingencies to be able to approve this project at this meeting.  The contingencies include:

            1) the removing of the parking spaces in the front

            2) the building elevations

            3) the drainage calculations being reviewed by the Town Engineer

            4) the landscaping agreement with the neighbors

 

Mr. Turner told the Board that they had to have approval within a short time because they were under many time constraints.  He asked if the Board could hold a special meeting in the next couple of days to approve this site plan. 

 

Motion made by Dan Evans, seconded by Ron Calanni to convene executive session . (7:48 PM to  8:00 PM)

The Planning Board reviewed the site plan checklist noting:

            1) the creek is relatively dry

            2) the drainage calculations were provided to the Town by Mr. Erickson

            3) parking will be concrete paved

            4) the dumpster will be fenced in

            5) the fire hydrants must be shown on the plans

            6) the BPU will determine if the utilities will be above or underground

            7) sign will be 32 square foot on a post in front of the building

            8) the lighting will meet criteria of the code

            9) this is not a warehouse and will be used for retail sales

            10) the applicant will meet with the neighbors concerning the landscaping

            11) Mr. Erickson has had conversation with NYS DOT concerning the curb cut

            12) project will require a permit from South and Center Sewer District for the sewer

            13) the Town would like a copy of the cross easement with Dairy Queen

 

Chairman Evans reviewed for Mr. Erickson and the applicant the items needed for approval:

            1) they need to eliminate the four parking spaces in the front

            2) the applicant must meet with the Petersons concerning the landscaping and Mr. Erickson

                will add the landscaping to the plans

            3) the building elevations must be shown on the plans

            4) the drainage must be approved by the Town engineer and fees paid by the applicant – Mr.

                Woodbury will contact Mr. Tolman for a cost

            5) fire hydrants must be shown on the plans

            6) applicant must get applicable permit from the NYS DOT

            7) a 4 foot fence is required around the pond with a gate so property can be maintained

 

Motion made by Dave Carlberg, seconded by Ron Calanni to table this project until the applicant has the plans completed and Mr. Tolman has reviewed the drainage.
