Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

December 16, 2002 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Geisler, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker, Legislator Spicer.

 

Supervisor Tyler opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.   Town Clerk Erlandson called the roll.

 

APPROVAL OF MINUTES

 

Motion by Councilman Lodestro, seconded by Councilman Geisler to accept the minutes of the December 2, 2002 meeting as presented by the Town Clerk.

                PRIVILEGE OF THE FLOOR

 

The Council & Legislator Spicer discussed a proposal to increase the Chautauqua County sales tax by one percent.

 

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

 

1.      Notification of liquor license renewal: Alfie’s Restaurant, 986 Fairmount Ave. WE.

2.      Newsletter: Chautauqua Watershed Conservancy.

3.      Falconer Fire Incident Report: October 2002.

 

TOWN OFFICERS’ REPORTS

 

Councilman Miller asked about the status of contract negotiations between the Town of Ellicott and the Celoron Hose Co. re fire protection in Fire District #1.  Supervisor Tyler stated that negotiations have not yet begun.  Mr. Miller recommended that Councilman Geisler also be involved in the negotiations.  Mr. Geisler agreed to assist Mr. Tyler. 

 

Councilman Lodestro asked about the status of negotiations between the Town of Ellicott and the CSEA Highway Employees re a new labor agreement.  Councilmen Miller & Taylor noted that they are representing the Town in the negotiations.  However, they explained that, to date, the Town has not been contacted by the CSEA.  The Council pointed out the CSEA was notified on October 8, 2002 that the town of Ellicott was prepared to begin negotiations.

Mr. Lodestro also asked about the status of drafting a labor policy for Town of Ellicott non-union employees.  He pointed out that a committee was recently formed to review current policies for non-union personnel (Minutes 4/15/02) The Council discussed the matter.

 

OLD BUSINESS

 

Traffic Safety Concerns: Fairmount Ave. – Supervisor Tyler reported that representatives of the Town of Ellicott will meet with other concerned officials in January 2003 to address traffic safety issues involving Fairmount Ave. in West Ellicott.

 

Water Service on Camp St. Ext. – Highway Superintendent Shellhouse reported that residents along Camp St. Ext. are in the process of determining the location of curb boxes on their property.  He explained that each resident has been asked to place a stake on his/her property at the preferred location of the curb box.  Mr. Shellhouse also reported that he is negotiating with Jamestown Board of Public Utilities officials re the installation of the curb boxes.

 

Water Service on Orchard Rd. – Highway Superintendent Shellhouse reported that he and Engineer Rex Tolman are looking into two (2) scenarios re the installation of a municipal water line on Orchard Rd. & Southwestern Dr.  He & Mr. Tolman will meet with Councilmen Geisler & Taylor in January 2003 to review the plans in further detail.

 

NEW BUSINESS

 

RESOLUTION #145-02

Reappointment to Planning Board (Evans)

 

Motion by Supervisor Tyler, seconded by Councilman Taylor reappointing Daniel Evans, 444 Hunt Rd. WE, to a seven-year terms on the Town of Ellicott Planning Board, effective January 1, 2003; term to expire December 31, 2009.

RESOLUTION #146-02

BAN (Renovation of Building)

 

Motion by Supervisor Tyler, seconded by Councilman Lodestro authorizing the issuance and sale of a Bond Anticipation Note in the amount of $398,400.00 for the renovation of the Ellicott Administration Building in Falconer, New York.  (see ‘BAN’ file for detail)

RESOLUTION #147-02

Budget Transfers


Motion by Supervisor Tyler, seconded by Councilman Miller authorizing Town of Ellicott Supervisor to make the following budget transfers:

 

Transfer the amount of $6,000.00 from Account #A1110.1 (Justice – Personal Services) to Account #A601 (Accrued Liabilities for Elizabeth Ribaudo retirement); transfer the amount of $4,777.80 from Account #A1620.4 (Buildings - Contractual) to Account #A601 (Accrued Liabilities for Elizabeth Ribaudo retirement); transfer the amount of $13,893.00 from Account #A9015.8 (Police Retirement) to Account #A601 (Accrued Liabilities for Elizabeth Ribaudo retirement); transfer the amount of $8,679.97 from Account #A1620.4 (Buildings - Contractual) to Account #A9060.8 (Medical Insurance); transfer the amount of $200.00 from Account #A1110.1 (Justice – Personal Services) to Account #A1110.4 (Justice – Contractual); transfer the amount of $6,883.00 from Account #A9010.8 (Retirement) to Account #A1910.4 Unallocated Insurance); transfer the amount of $2,629.26 from Account #B9060.8 (Medical Insurance) to Account #B3620.1 (Safety Inspection – Personal Services); transfer the amount of $218.27 from Account #B9060.8 (Medical Insurance) to Account #B9030.8 (Social Security).

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Lodestro to pay 2002 current claims #1517-1611, inclusive, in the amount of $42,470.61 and charge to the proper fund or account.
