Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

November 21, 2001 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Hendrickson, Councilman Lodestro, Councilman Miller, Town Clerk Erlandson, Attorney Duncanson.

 

Absent: Councilman Taylor, Highway Superintendent Shellhouse.

 

Supervisor Tyler opened the meeting at 7:00 P.M. and led the Town Council in the Pledge of Allegiance.  Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

 

Motion by Councilman Miller, seconded by Councilman Lodestro to accept the minutes of the November 7, 2001 meeting as presented by the Town Clerk.

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

1.      Invitation to the annual Falconer Volunteer Firemen’s Association Christmas Party.

2.      Police Activity Report: October 2001.

 

TOWN OFFICERS’ REPORTS

 

Councilman Lodestro reported that Chautauqua County will provide a $182,000.00 no interest loan to the Town of Ellicott for the possible reconstruction of Lyndon Blvd.

 

Mr. Lodestro also reported that a number of residents on Camp St. Ext. have expressed an interest in receiving municipal water service.  He suggested that the Town conduct an informational meeting with residents early in 2002 to determine whether to move forward with the project.

 

Mr. Lodestro reported that Attorney Gregory Yaw is providing legal advice to developers of a potential subdivision on West Oak Hill Rd.  Mr. Lodestro pointed out that the developers are responsible for paying all fees involving Mr. Yaw’s services.

 

Town Clerk Erlandson reported that he received a letter of resignation from Patrick McLaughlin as a member of the Town of Ellicott Planning Board, effective immediately.  The Town discussed possible candidates to fill the vacancy on the Planning Board.

Motion by Councilman Lodestro, seconded by Supervisor Tyler to accept the resignation of Patrick W. McLaughlin from the Town of Ellicott Planning Board.

Attorney Duncanson reported that he received a letter from a local law firm soliciting the Town of Ellicott’s business on future projects that require bond counsel.  Councilman Lodestro suggested that Attorney Duncanson discuss the matter with Attorney Gregory Yaw.

 

Supervisor Tyler noted that he received a letter from Southwestern Central School officials re the disposition of the Celoron & Lakewood school buildings.  He reported that school officials would hold a meeting on Nov. 29, 2001 to discuss the matter.

 

OLD BUSINESS

           

Agreements w/ Town of Ellicott Employees – Tabled pending further review.

 

Buffalo-Willard Water Project – Councilman Lodestro reported that the process of finalizing the legal & financial obligations re the Buffalo-Willard Water Distribution project is in the final stages.  He explained that a letter will be mailed to residents within the water service area outlining their payment options.

 

Renovation of Administration Building – Councilman Hendrickson reported on the progress of the Ellicott Administration Bldg. renovation project.

 

Water/Sewer Service on Fluvanna Ave. Ext. & Orchard Rd. – Town Clerk Erlandson summarized the results of a survey recently conducted by the Town of Ellicott re the possible installation of water & sewer service to Fluvanna area residents.  He reported that 64% of the residents are not interested in receiving water service and 81% do not desire sewer service.  The Council discussed the results.  Mr. Erlandson & Councilman Taylor will review the survey results and make a recommendation on how to proceed.

 

NEW BUSINESS

 

RESOLUTION #150-01

Contract w/ Humane Society

 

Motion by Supervisor Tyler, seconded by Councilman Hendrickson to accept an Annual Holding Agreement between the Chautauqua County Humane Society and the Town of Ellicott for fiscal year 2002.   (see ‘Chaut. Co. Humane Society’ file for detail)

RESOLUTION #151-01

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Hendrickson, to pay current claims 1392-1431, inclusive, in the amount of $50,987.69 to the proper fund or account.
