Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
November 7,
2005 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker, Legislator Spicer.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Heintzelman, seconded by Councilman Miller to accept the minutes
of the October 17, 2005 meeting as presented by the Town Clerk.
PUBLIC
HEARING (2006 Preliminary Budget)
Supervisor Tyler opened a Public Hearing on the Town of Ellicott Preliminary Budget for fiscal year
2006. The following public comments were heard:
Town of Ellicott Justice Marilyn
Gerace addressed the Town Council re the proposed budget. Justice Gerace expressed her concern that
the Council reduced the proposed 2006 allocation for overtime for the Court
Clerk by $2,000.00. In her opinion, the
proposed reduction would aversely affect court operations. She asked the Council not to reduce the
overtime allocation.
Town of Ellicott Justice Samuel
Ognibene also commented on the budget.
He stated that he agrees with Justice Gerace in regards to the proposed
overtime allocation. He requested that
the Council not reduce the allocation.
The Town Council discussed
Justices’ request.
Re-allocate Overtime Funding
for Town Court
Motion by Councilman Pickett,
seconded by Councilman Geisler to increase Account #A1110.1 (Court – Personal
Services) by $2,000.00 in the proposed Town of Ellicott Preliminary Budget for
fiscal year 2006.
Supervisor Tyler closed the
Public Hearing at 7:23 PM
Town Clerk Erlandson read the
following items into the record:
1.
Notice
re an upcoming Fall Planning & Zoning Conference sponsored by Southern
Tier West Regional Planning & Development.
2.
Letter
from the Cha-tau-qua Squares Square Dance Club thanking the Town Council
for allowing them to use the Senior Citizens’ Center to conduct dances
last summer.
3.
Notice
from Chautauqua County Finance Dept. re properties scheduled for auction
due to non-payment of taxes.
4.
Letter
from New York State Dept. of State that Town of Ellicott Local Law
#4-2005 has been received & filed.
5.
Newsletter:
Community Assistance Program.
TOWN OFFICERS’ REPORTS
Councilman Heintzelman reported that he has
received complaints about speeding on Bentley Ave. in Fluvanna. Highway Superintendent Shellhouse stated
that he is in the process of requesting permission from the NY State Dept.
of Transportation to reduce the speed limit to 30 mph.
Councilman Pickett reported on the progress of building
alterations at the Town Administration Bldg.
He reminded the Council that the alterations are being conducted in
conjunction with the re-location of the NYS Dept. of Environmental
Conservation offices from the third floor to the first floor of the
building (Minutes 1/3/05 et. seq.). He
stated that, to date, $8,942.00 has been spent on first floor alterations and
$7,290.00 for remodeling on the third floor.
Mr. Pickett also added that in accordance with the lease agreement with DEC
the Town is required to install carpet
in certain sections of the new DEC offices. He noted that the Town has currently received only one (1) bid
for the carpet in the amount of $5,200.00.
He expects more bids to be submitted.
Project Coordinator John Piazza answered
several questions re the alterations.
Mr. Pickett also noted that the Town has received two (2) bids for new
internal and external signage at the Administration Bldg.
PROCLAMATION
Supervisor Tyler proclaimed November 14 - 20, 2005 Advanced
Care Plan Week in the Town of Ellicott.
OLD BUSINESS
RESOLUTION #96-05
Adopt Final Budget (2006)
Motion by Supervisor Tyler, seconded by Councilman Geisler to adopt the Town of Ellicott Preliminary Budget for fiscal year 2006 (as revised in RESOLUTION #95-05) as the final budget for fiscal year 2006.
NEW BUSINESS
Fire Hydrants on N. Main St. Ext. –
Highway Superintendent Shellhouse reported that Fluvanna Fire Dept.
officials have requested that four (4) fire hydrants
be installed along N. Main St. Ext. (Rte. 60) in the Town of Ellicott. The hydrants would be installed at Horton
Rd., Palm Rd., Moon Rd. & Tompkins Rd.
The cost
of the four hydrants would be approximately $14,000.00 ($3,500.00 ea.). Supervisor Tyler noted that there is
presently no funding available in the Town budget to purchase the hydrants. He plans on meeting with fire dept.
officials to discuss other options.
Town Clerk Erlandson was directed to contact NYS Senator Catharine Young
and NYS Assemblyman William Parment to determine if state funding
might be available to install the hydrants.
Tabled pending further review.
RESOLUTION #97-05
Waive Permit Fees (Fluvanna
Fire Dept.)
Motion by Supervisor Tyler, seconded by Councilman Heintzelman to waive
all permit fees in conjunction with the construction of its new fire station on
Turner Rd.
RESOLUTION #98-05
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Heintzelman to pay 2005
current claims #1185-1257 inclusive, in the amount of $84,501.84 and charge
to the proper fund or account.
