Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
November 4,
2002 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Miller, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.
Absent: Councilman Lodestro, Councilman Taylor.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
PUBLIC
HEARING (2003 Preliminary Budget)
Supervisor Tyler opened a Public Hearing on the Town of Ellicott Preliminary Budget for fiscal year
2003. The following public comments were heard:
Celoron Village Clerk Vikie
Strong asked the Town Council if monies have been allocated in the 2003
budget for the installation of a traffic light on Fairmount Ave. (Rte. 394) in
front of Sam’s Club. Supervisor
Tyler replied that funding for a light has not been allocated. Ms. Strong read a statement in support of installing
a traffic light. She explained that the
estimated cost of installing the light is $100,000.00. However, she noted that Sam’s Club is
willing to pay half that cost. Ms.
Strong requested that the Ellicott Town Council allocate funding for the traffic
light. She pointed out that traffic
safety conditions along Fairmount Ave. have become increasingly dangerous. She feels that the Town Council has a
responsibility to protect its citizens.
Mr. Jack Keeney spoke on behalf of the Southwestern
Area Baseball Program. Mr. Keeney
explained that the Little League Field in Burtis Bay is in poor condition. He requested that the Town of Ellicott
consider providing assistance in upgrading the field.
Motion by Supervisor Tyler,
seconded by Councilman Miller to close the Public Hearing at 7:21 PM.
APPROVAL OF MINUTES
Motion
by Councilman Miller, seconded by Councilman Geisler to accept the minutes of
the October 21, 2002 meeting as presented by the Town Clerk.
PRIVILEGE OF THE FLOOR
Village of Celoron Trustee Pam
Piazza commented on the traffic situation along Fairmount Ave. In her opinion, a traffic light should be
installed in front of Sam’s Club.
Ms. Helen Sischo, Celoron, also feels that a
traffic light should be installed at Sam’s Club. She asked the Town Council to address the
matter.
Town Clerk Erlandson read the
following items into the record:

Letter
fro the Chautauqua County Humane Society re the opening of a new animal
holding center.
2.
Notice
from the Chaut. Co. Board of Elections re a possible impoundment order
on election night – Nov. 5, 2002.
3.
Notice
from the New York State Dept. of Environmental Conservation re the
issuing of deer-management permits.
4.
Newsletter:
Chaut. Co. Soil & Water Conservation District.
5.
Newsletter:
Community Assistance Program.
Councilman
Geisler reported that the Southwestern
Area Baseball Program is interested in leasing the baseball field at Burtis
Bay for advertising purposes. Attorney
Lasker is looking into the matter.
Highway
Superintendent Shellhouse reported
that the final inspection of Falconer Industrial Park has been
completed.

BUSINESS
RESOLUTION #133-02
Adopt Final Budget (2003)
Motion by Supervisor Tyler, seconded by Councilman Miller to adopt the Town of Ellicott Preliminary Budget for fiscal year 2003 as the final budget for fiscal year 2003 pending the reduction of the amount allocated in Account #A5010.1 (Highway Superintendent – Personal Services) from $55,674.00 to $54,046.00.
Water Service on Camp St. Ext. – Highway Superintendent Shellhouse reported that construction of the new water line on a section of Camp St. Ext. is underway. He noted that the project should be completed in the next several weeks.
Water Service on Orchard Rd. – Highway Superintendent Shellhouse presented a map plan of a proposed water line on Orchard Rd. & Southwestern Dr. Mr. Shellhouse explained that the proposed line would need to be connected to a water line currently being installed on Baker St. Ext. in the Town of Busti. Supervisor Tyler will meet with Town of Busti & Village of Lakewood officials to discuss an inter-municipal agreement, which would enable the Town of Ellicott to connect to the Busti water line.

RESOLUTION #134-02
Inter-Municipal Agreement re
Herbicide Application on Chautauqua Lake
Motion by Councilman Miller, seconded by Councilman Geisler authorizing the
Ellicott Town Supervisor to sign an agreement with the Town of Busti and
the Town of Ellery designating the Town of Ellicott as Lead Agency
pursuant to the New York State Environmental Quality Review Act to determine
whether the spraying of herbicides to control weeds in the lower basin
of Chautauqua Lake is environmentally appropriate. (see ‘Burtis Bay Milfoil’ file for detail)
RESOLUTION #135-02
Budget Transfers
Motion by Supervisor Tyler, seconded by Councilman
Miller authorizing Town of Ellicott Supervisor to make the following budget
transfers:
Transfer the amount of $461.54 from Account #A9010.8 (Retirement) to Account
#A1420.1 (Attorney - Contractual); transfer
the amount of $332.00 from Account #A9010.8 (Retirement) to Account
#A3510.4 (Dog Control – Contractual).
RESOLUTION #136-02
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Geisler to pay 2002 current claims #1316-1381,
inclusive, in the amount of $20,061.97 and charge to the proper fund or
account.
