Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
October 17,
2005 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Miller, seconded by Councilman Heintzelman to accept the minutes
of the October 3, 2005 meeting as presented by the Town Clerk.
PRIVILEGE OF THE FLOOR
Mr. Douglas Shute, President, Southwestern Area Sports Baseball
Program, addressed the Town Council re the status of upgrades to the Burtis
Bay Little League field located on Lakeside Dr. in the Town of
Ellicott. He explained that his
organization has plans to make significant improvements to the Little League
field. He noted that funding to upgrade
the field’s drainage system has been secured.
Mr. Shute asked the Town Council to allocate $2,500.00 towards
additional upgrades. He also asked the
Council to budget monies each year for maintenance of the ball field. The Council will consider Mr. Shute’s
request. Highway Superintendent
Shellhouse reported
that the Ellicott Highway Dept. has been assisting the Baseball Program
with some of the upgrades.
Town Clerk Erlandson read the
following items into the record:
1.
Notice
re an upcoming Fall Planning & Zoning Conference sponsored by Southern
Tier West Regional Planning & Development.
2.
Letter
from the Chautauqua County Humane Society stating that there will be no
fee increase in 2006 for services provided by the Stray Animal Holding
Center.
3.
Notice
from Chaut. Co. Finance Dept. re properties that have been foreclosed due
to non-payment of taxes.
4.
Newsletter:
Chaut. Co. Chamber of Commerce.
TOWN OFFICERS’ REPORTS
Councilman Heintzelman asked Highway
Superintendent Shellhouse about the status of installing a new stop sign at the
intersection of Sycamore & S. Hanford in West Ellicott. (Minutes 4/4/05 et. seq.) Mr. Shellhouse reported that the signs
should be installed within the next several weeks.
Councilman Geisler reported that before tonight’s meeting, the
Ellicott Insurance Committee met with the Town’s health insurance broker. According to Mr. Geisler, the broker
recommended that the Town change the effective date of its employee health
insurance plan to December 1, 2005.
Doing so would ensure that the Town “locks in” its current employee
benefits through the end of 2006.
Motion by Councilman Geisler, seconded by Councilman
Miller requesting Bluecross Blueshield of Western New York Change the effective date of the Town of Ellicott Employee Health Care
Plan from February 1, 2006 to December 1, 2005.
Town Clerk Erlandson reported that alterations
to the Ellicott Administration Bldg. will get underway in the next several
weeks. Mr. Erlandson reminded the Town
Council that the alterations are being conducted in conjunction with the
re-location of the New York State Dept. of Environmental Conservation
offices from the third floor to the first floor of the Bldg. (Minutes 1/3/05
et. seq.) He also noted that members of
the Town of Ellicott Highway Dept. would be conducting the alterations on their
own time. Mr. Erlandson added that the
alterations should be completed by mid-November 2005.
Mr. Erlandson also reminded the Town Council that
Halloween hours in the Town of Ellicott and Village of Falconer will be 5:30 PM
– 7:00 PM on October 31, 2005. In the
Village of Celoron, the hours will be 6:00 PM – 8:00 PM on the 31st.
OLD BUSINESS
Pump Station in Water
District 1 (School Ave. Area) – The Town Council discussed a proposal to install a
pump station in the School Ave. area of West Ellicott (Minutes
10/3/05). Highway Superintendent
Shellhouse pointed out that the Jamestown Board of Public Utilities (BPU)
would be installing the pump station.
He stated that the proposal has been tabled for the time being
pending further negotiations with the BPU. Supervisor Tyler reported that he recently met with Wally Haase,
Executive Director of the BPU re the status of water districts in
the Town of Ellicott. Mr. Tyler
explained that, according Mr. Haase, the BPU is interested in taking
over all water districts within the Town of Ellicott. Mr. Tyler noted that such an arrangement
could be beneficial to the Town by reducing the operational and maintenance costs
associated with the water districts. He
added that should such an agreement be reached, the BPU would be
responsible for installing the pump station in the School Ave. area. Mr. Tyler stated that he would keep the
Council informed re the status of his discussions with Mr. Haase.
Tentative Budget (2006) - Supervisor Tyler scheduled
meetings with department heads to discuss the Tentative Budget for Town of Ellicott fiscal year 2006.
Motion by Supervisor Tyler, seconded by Councilman Geisler to schedule a Public Hearing for November 7, 2005 at 7:00 PM regarding the proposed Town of Ellicott Preliminary Budget for fiscal year 2006.

NEW BUSINESS
RESOLUTION #92-05
BAN Renewal (Ninth St.
Bridge)
Motion by Supervisor Tyler, seconded by Councilman Pickett authorizing the
issuance of a Bond Anticipation Note
in the amount of $12,800.00 for repair of the Ninth St. Bridge. (see
‘BAN’ file for detail)
Funding
for Chautauqua Lake Association – Mr. Don Castle, President, Chautauqua Lake Association addressed
the Town Council. Mr. Castle thanked
the Council for its annual $2,500.00 contribution to the CLA. He asked the Council to increase its annual funding allocation to $5,000.00
beginning in 2006. Mr. Castle explained
that operational costs of the CLA have increased dramatically over the
past several years. He discussed the
services that are provided by the CLA.
CLA Board member Mr. Robert Woodard
asked the Council to seriously consider Mr. Castle’s request for additional
funding. Supervisor Tyler stated that
the Council would consider the matter during its preparation of the 2006 Town
of Ellicott Budget.

Transfers
Motion by Supervisor Tyler, seconded by Councilman
Geisler authorizing the Town of Ellicott Supervisor to make the following
budget transfers:
Transfer the amount of $60.00 from Account #A1410.1
(Town Clerk – Personal Services) to Account #A1410.4 (Town Clerk –
Contractual); transfer the amount of $25.85 from Account #A1410.1 (Town Clerk –
Personal Services) to Account #A1680.4 (Data Processing - Contractual);
transfer the amount of $358.38 from Account #A1410.1 (Town Clerk – Personal
Services) to Account #A3510.2 (Dog Control - Equipment).

RESOLUTION #94-05
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Miller to pay 2005
current claims #1116-1184, inclusive, in the amount of $47,620.65 and
charge to the proper fund or account.
