Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
October 7,
2002 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse.
Absent: Councilman Geisler.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
PUBLIC HEARING (Local Law #4-2002:
Revise Boundaries of Empire Zone)
Supervisor Tyler opened a Public Hearing
on proposed Town of Ellicott Local Law #4-2002 revising the
boundaries of the Greater Jamestown Empire Zone. The following public comments were heard:
Ms. Sally Martinez, Director, Greater
Jamestown Empire Zone, outlined the proposed revisions to the GJEZ. She noted that the GJEZ includes areas
within the City of Jamestown, Village of Falconer, Town of Ellicott & Town
of Busti. The Council asked Ms.
Martinez several questions re the areas involving the Town of Ellicott.
Supervisor Tyler closed
the Public Hearing at 7:10 PM.
APPROVAL OF MINUTES
Motion
by Councilman Miller, seconded by Councilman Taylor to accept the minutes of
the September 16, 2002 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the
following items into the record:
1.
Letter
from Western N.Y. & Pa. Railroad thanking the Ellicott Police Dept.
for conducting a check of its premises.
2.
Notification
from N.Y. Dept. of State that Town of Ellicott Local Law #2-2002 has been
received & filed.
3.
Newsletter:
Chautauqua Watershed Conservancy.
Councilman Lodestro reported that he recently attended a meeting re the Lyndon Blvd. Reconstruction Project. He noted that the project is nearing completion. He also noted that the Town of Ellicott might not have to pay the $37,000.00 fee for a construction inspector as stipulated in Town of Ellicott Resolution #90-02 (Minutes 4/29/02). Mr. Lodestro noted that surplus monies might be available to cover the fee.
Mr. Lodestro also asked about the progress of negotiations between the Town of Ellicott and the CSEA Highway Employees re new labor agreement. Town Clerk Erlandson was directed to notify the union in writing that the Town is prepared to begin negotiations.
Mr. Shellhouse reported that he is negotiating with a business in Lyndon Park re the installation of a new drainpipe across a section of Third Ave.
Mr. Shellhouse also reported that his department recently paved a street behind the Ellicott Highway Garage.

BUSINESS
Motion by Supervisor Tyler, seconded by Councilman Miller supporting and
concurring with the City of Jamestown’s actions to submit an application
for a boundary revision to the Greater Jamestown Empire Zone. (see ‘Empire Zone’ file for detail)
Adopted. Ayes - 4 Noes - 0 Absent - 1
Water Service on Camp St. Ext. – Highway Supt. Shellhouse reported that the Town of Ellicott Highway Dept. recently received the pipe for the new Camp St. Ext. water line. He stated that the Highway Dept. intends to install the water line in the next several weeks.
NEW BUSINESS
Motion by Supervisor Tyler, seconded by Councilman Taylor authorizing the Town
of Ellicott Supervisor to sign an agreement between the Town of Ellicott
and the Chautauqua Lake Association stipulating that the Town pay
the CLA the amount of $2,500.00 (two thousand five hundred dollars) for a lake
maintenance program conducted in 2002.

Motion by Supervisor Tyler, seconded by
Councilman Lodestro to schedule a Public Hearing for October 21, 2002 at
7:00 PM to discuss proposed Town of Ellicott Local Law #5-2002 amending a section of the Town of Ellicott Code
regarding garage sales.
Request for Sick Days (Town
of Ellicott Assessor) – Town of Ellicott Assessor Patricia Eimers requested that she be
allowed to accumulate unused sick leave.
The Council will consider Mrs. Eimer’s request.
Alternative Veterans’
Exemption –
Town of Ellicott Assessor Patricia Eimers reported that the Chautauqua Co.
Legislature recently approved a new alternative property tax exemption
for veterans. She explained that area
veterans’ groups would be urging local municipalities to adopt the exemption as
well. Mrs. Eimers recommended that the
Ellicott Town Council not adopt the exemption at the present time. In her opinion, the Council should wait at
least a year to determine what impact the exemption will have on the County’s
budget.
Tentative
Budget (2003) - Supervisor Tyler presented the Tentative
Budget for Town of Ellicott fiscal year 2003. He stated that the proposed budget contains significant property tax
increases. Mr. Tyler feels that
such tax increases are unacceptable & explained that many reductions will be made before the
final budget is adopted. The Council
will meet several times during the next several weeks to review the proposed
budget and make the necessary reductions.
RESOLUTION #127-02
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Taylor to pay 2002 current claims #1172-1250,
inclusive, in the amount of $31,791.99 and charge to the proper fund or
account.
