Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
October 16,
2006 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson.
Absent: Councilman Geisler, Highway Superintendent Shellhouse.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Heintzelman, seconded by Councilman Miller to accept the minutes
of the October 2, 2006 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the
following items into the record:
1.
Notice
of upcoming Fall Planning & Zoning Conference.
2.
Invitation
to a dinner sponsored by the Chautauqua County Conference of Mayors.
3.
Letter
from New York State Senator Catharine Young notifying Ellicott officials that a
$10,000.00 local initiative for the Town has been included in the State budget.
4.
Letter
from Kelly SanFillippo-Derby, President, Southwestern Area Sports, Inc.
outlining certain upgrades that need to be made to the Burtis Bay Little
League field.
TOWN OFFICERS’ REPORTS
Councilman Heintzelman directed Town Clerk
Erlandson to contact the Fluvanna Fire Dept. to discuss how to allocate funding
that was recently appropriated to the Town of Ellicott by NYS Assemblyman
William Parment & NYS Senator Catharine Young. The funding will be used to install fire hydrants along N. Main
St. Ext. (Rte. 60) in the Town of Ellicott.

Supervisor Tyler reported that he received a
notice from the NYS Dept. of Transportation re the status of the Wicks
Ave. railroad crossing in West Ellicott.
(Minutes 6/19/06) He explained
that the DOT has mandated that the railroad crossing be permanently
closed no later than December 10, 2006.
He added that the Town of Ellicott Highway Dept. & the Chaut. Co. Dept.
of Public Works would be responsible for closing the railroad
crossing. Mr. Tyler also noted that, in
conjunction with closing the railroad crossing, the Ellicott Highway Dept. & County DPW would be required to
connect Wicks Ave. with Green St. as well as extend Green St. south to connect
with Fairmount Ave. He stated that the
DOT would reimburse the Town $50,000.00 for the work.

– Tabled until the November 6, 2006 Town Council meeting.
Veterans’ Property Tax
Exemption
- Tabled pending further review.
Tentative Budget (2007) - Supervisor Tyler discussed
the proposed preliminary budget for the Town of Ellicott for fiscal year
2007. He explained that the preliminary
budget includes a property tax increase of $0.45 per thousand for Town
residents and an increase of $0.11 for village residents. He stated that, in his opinion, the proposed
tax increases are unacceptable. He
scheduled a meeting for Oct. 24, 2006 for the Town Council to discuss the tentative budget to determine how to
reduce the proposed tax increases.
Motion by Supervisor Tyler, seconded by Councilman Pickett to schedule a Public Hearing for November 6, 2006 at 7:00 PM regarding the proposed Town of Ellicott Preliminary Budget for fiscal year 2007.

RESOLUTION
#82-06
BAN (New Trucks)
Motion by Supervisor Tyler, seconded by Councilman Miller authorizing the
issuance and sale of a Bond Anticipation Note in the amount of $187,664.65 for
the purchase of a 2006
F-350 Ford Pickup Truck, a 2006 International 7300 Dump Truck and a 2007 Ford
F550 Dump Truck. (see ‘BAN’ file for detail)

RESOLUTION #83-06
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Heintzelman to pay 2006
current claims #1127-1192, inclusive, in the amount of $15,429.97 and
charge to the proper fund or account.
