Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
October 2,
2006 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Legislator Spicer.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Miller, seconded by Councilman Heintzelman to accept the minutes
of the September 18, 2006 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the
following items into the record:
1.
Notice
of upcoming Fall Planning & Zoning Conference.
2.
Letter
from Steve & Karen Johnson, 95 Longview Ave. re sediment buildup in a
stream near their home.
3.
Letter
from James Barnack, New York State Dept. of Transportation re traffic
safety conditions on Rte. 60 in the Town of Ellicott.
4.
Newsletter:
Chautauqua County Chamber of Commerce.
TOWN OFFICERS’ REPORTS
Councilman Heintzelman reported that he recently
attended a meeting conducted by the Chautauqua Lake Management Commission. He noted that the meeting was productive
& well attended.
Councilman Geisler stated that he and
Councilman Heintzelman have scheduled a meeting with CSEA representatives for
Oct. 23, 2006 at 6:00 PM to begin negotiating a new labor agreement between the
Town of Ellicott and Town of Ellicott highway/office employees.
Mr. Geisler also noted that he recently
met with the Town of Ellicott’s health insurance brokers to discuss the status
of employee health insurance.
Mr. Geisler also read a letter from the
NYS Association of Municipal Finance Officers recognizing Celoron
Village Clerk Vikie Strong as a Credentialed Municipal Finance Officer. Mr. Geisler congratulated Ms. Strong on
receiving the honor.
Town Clerk Erlandson reported that a member of
U.S. Congressman Brian Higgins’ staff will conduct a “congressman’s corner” at
the Ellicott Administration Bldg. on Oct. 3, 2006 at 5:30 PM. He explained that the informal town meeting
is open to the public and gives elected officials and residents an opportunity
to discuss issues and express various concerns.
Supervisor Tyler asked Councilmen Geisler
& Heintzelman how the new Ellicott Zoning Commission was
progressing. Councilman Geisler noted
that the commission recently met and prioritized a number of zoning issues that
it intends to address. Mr. Geisler
& Mr. Heintzelman scheduled another Zoning Commission meeting for
Oct. 9, 2006 at 6:00 PM.
Water Pump Station in School
Ave. Area
- Highway Superintendent Shellhouse reported on the status of plans to install
a new water pump station in the School Ave. area. (Minutes 7/11/06 et. seq.) He noted that Tolman Engineering officials
would begin the design phase of the project as soon as they receive a
survey of the property.

RESOLUTION #79-06
Shared Municipal Services Incentive Grant Program
Motion by Supervisor Tyler, seconded by Councilman Miller authorizing the Ellicott
Town Supervisor to execute any and all documents necessary to apply for, accept
and implement a grant from the Shared Municipal Services Incentive
Grant Program with Chautauqua County and the other municipalities within
Chautauqua County. (see ‘Highway Dept.

BAN Renewal
(Roller)
Motion by Supervisor Tyler, seconded by Councilman Geisler authorizing the
issuance of a Bond Anticipation Note
in the amount of $50,800.00 for the purchase of a 2004 Ingersoll-Rand Model DD-90 Roller for the Town of Ellicott Highway
Department. (see 'BAN' file for
detail)
Tentative Budget (2007) - Supervisor Tyler presented
the Tentative Budget for Town of
Ellicott fiscal year 2007. He stated
that the proposed tax rate for the Town of Ellicott (i.e. Town
outside Village) for 2007 is $7.50 per thousand while the proposed Village tax
rate is $5.26 per thousand. Mr. Tyler
commented on the budget & noted that the proposed tax rate is a significant
increase from 2006. However, he stated
that the Council would meet over the next several weeks to examine the budget
to determine whether any proposed expenditures can be reduced.
Rezoning Request (Fairmount
Plaza) – The Town Council discussed a letter requesting
the Ellicott Town Council to rezone several parcels of property
around Fairmount Plaza between Avalon Blvd. and Elmwood Ave. The letter requests that the properties be
rezoned from either ‘Shopping Center’ or ’Residential’ to
‘Mercantile’.
Motion
by Supervisor Tyler, seconded by Councilman Pickett to refer a request to rezone
several parcels of property around Fairmount Plaza between Avalon Blvd.
and Elmwood Ave. to the Ellicott Planning Board for further review.

RESOLUTION #81-06
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Geisler to pay 2006 current
claims #1057-1126, inclusive, in the amount of $15,429.97 and charge to the
proper fund or account.
