Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

September 18, 2006 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Geisler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse.

 

Supervisor Tyler opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

 

Motion by Councilman Heintzelman, seconded by Councilman Geisler to accept the minutes of the August 21, 2006 meeting as presented by the Town Clerk.

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

                                   

1.      Notice of upcoming Fall Planning & Zoning Conference.

2.      Letter from George Wallace, Cha-tau-qua Squares Dance Club, thanking Town officials for allowing his club to use the Ellicott Community Center to conduct dances.

3.      Notice re an upcoming benefit fund-raiser ighway Hihonoring two New York State Troopers.

4.      Letter from NYS Assemblyman William Parment notifying Town of Ellicott officials that a $10,000.00 local initiative for the Town has been included in the State budget.

5.      Letter from Larry Mee, Highway Superintendent, Town of Poland, thanking the Town of Ellicott Highway Dept. for their recent assistance with storm cleanup.

6.      Notice of an upcoming teleconference re inter-municipal cooperation.

7.      Newsletter: Chautauqua County Chamber of Commerce.

 

TOWN OFFICERS’ REPORTS

 

Councilmen Miller and Pickett thanked Town of Ellicott & Village of Falconer officials for expediting the demolition of an abandoned house on E. Main St., Falconer formerly owned by Thomas Lovejoy.  (Minutes 8/21/06)

 

Councilman Heintzelman thanked the Chaut. Co. Dept. of Public Works for taking measures to improve traffic safety at the intersection of Baker St. Ext. and Southwestern Dr.  (Minutes Aug. 8, 2006) 

 

Councilman Geisler stated that he and Councilman Heintzelman will be meeting with CSEA representatives to begin negotiating a new labor agreement between the Town of Ellicott and Town of Ellicott highway & office employees.

 

Mr. Geisler also noted that U.S. Congressman Brian Higgins’ staff periodically conducts town meetings known as “congressman’s corner” at various localities throughout the congressional district.  He recommended that such a meeting be conducted at the Town of Ellicott.  He explained that the meetings would give elected officials and constituents an opportunity to discuss issues and express various concerns.

 

Supervisor Tyler congratulated Town and Village officials for expediting the demolition of the Lovejoy property.  (see above)

 

Mr. Tyler reported that he & Councilman Heintzelman recently attended the dedication ceremony for the new outdoor facility at Tanglewood Manor.  He stated that it is an outstanding facility and complimented Tanglewood officials for a job well done.

 

Mr. Tyler also reported that he & Councilman Heintzelman would be meeting with officials from the Celoron Hose Co. to discuss budgetary concerns.

 

Mr. Tyler also stated that the Falconer Central School Board has offered to reimburse the Town of Ellicott $20.00 per hour for providing the school with a School Resource Officer.  (Minutes 8/21/06)  He reminded the Town Council that it originally requested $22.00 per hour from the school.  The Council accepted the school board’s offer.

 

OLD BUSINESS

 

Drainage Study (Bentley Ave.) - Highway Superintendent Shellhouse reminded the Town Council about the drainage problems in the Bentley Ave. area north of Rte. 430.  (Minutes 6/19/06 et. seq.)  He stated that he has allocated monies for upgrading the drainage in his tentative budget for fiscal year 2007.  He will discuss the matter in more detail during the budget meetings next month.  Tabled pending further review.

 

Water Pump Station in School Ave. Area - Highway Superintendent Shellhouse reported on the status of plans to install a new water pump station in the School Ave. area.  (Minutes 7/11/06 et. seq.)  He noted that since a survey of the property has now been completed, Tolman Engineering could begin the design phase of the project.

 

Veterans’ Property Tax Exemption - Town Clerk Erlandson updated the Town Council on the “alternative” veterans’ property tax exemption program.  (Minutes 2/6/06)  He distributed copies of a financial analysis prepared by Ellicott Assessor Marsha Painter concerning the exemption.  He explained that in order to establish the exemption the Council must first adopt a resolution.  He pointed out that the resolution must be adopted no later than ninety (90) days prior to March 1 to be effective for the subsequent fiscal year.  Therefore, in order for the exemption to take effect in 2008, the resolution would have to be adopted no later than Nov. 30, 2006.  The Council discussed the matter.  Tabled pending further review.

 

NEW BUSINESS

 

RESOLUTION #76-06

National Incident Management System (NIMS)

 

Motion by Supervisor Tyler, seconded by Councilman Pickett to adopt the National Incident Management System (NIMS) as assisted and directed by the Chautauqua County Office of Emergency Services in accordance with Homeland Security Presidential Directive 5.  (see ‘National Incident Management System’ file for detail)

Accept Bids (ADA Accessible Entrance) – Town Clerk Erlandson asked the Town Council to conditionally accept three (3) bids for upgrading the north entrance of the Ellicott Administration Bldg. to comply with the Americans with Disabilities Act (ADA).  He explained that the Town of Ellicott might be receiving grant funding for the upgrades.

 

RESOLUTION #77-06

Accept Bids (ADA Accessible Entrance)

 

Motion by Supervisor Tyler, seconded by Councilman Miller to accept the following bids for upgrading the north entrance to the Ellicott Administration Building to comply with the Americans with Disabilities Act (ADA):

 

                        Micek Construction - $6,975.00 (new ramp to building)

                        Kingsview Paving - $3,525.00 (handicapped parking spaces & signage)

                        Tormax - $2,000.00 (electric ADA-complaint door)

RESOLUTION #78-06

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Miller to pay 2006 current claims #959-1056, inclusive, in the amount of $87,628.99 and charge to the proper fund or account.
