Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
August 19,
2002 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Lodestro, Councilman Miller, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.
Absent: Councilman Taylor.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Deputy Town Clerk Pierce called the roll.
APPROVAL OF MINUTES
Motion
by Councilman Lodestro, seconded by Councilman Miller to accept the minutes of
the August 5, 2002 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the
following items into the record:
1.
Notification
of Liquor License renewal: Jamestown Colony Motel.
2.
Notice
from New York State Dept. of Transportation re designation of restricted
highway.
3.
Invitation
to a dinner cruise on the Summer Wind for Chautauqua County elected
officials.
4.
Letter
from Chautauqua Watershed Conservancy re the purchase of lakefront
property.
5.
Newsletter
from the N.Y. State Assembly Committee on Local Government.
6.
Police
Activity reports: June & July 2002.
TOWN OFFICERS’ REPORTS
Councilman Lodestro reported that the Lyndon Blvd. Reconstruction project is proceeding on schedule.
Town Clerk Erlandson reported that N.Y. State Conservation licenses would not go on sale until Aug. 26, 2002. He explained that hunting & fishing licenses should have gone on sale Aug. 19. However, the N.Y. State Dept. of Environmental Conservation is having problems getting its new on-line database system operational.
Attorney Lasker reported that he is looking into the legal implications of a request to conduct logging operations on Town of Ellicott property located in Fluvanna Park.
Highway Superintendent Shellhouse reported that Abate Engineering is conducting structural tests on the 7th Avenue Bridge located in Celoron.
Mr. Shellhouse also reported that he is addressing a drainage problem in the Lewis St. area. Councilman Lodestro noted that Engineer Rex Tolman has been hired to conduct a drainage study of the problem.
Supervisor Tyler reported that he received a letter from the Superintendent of Southwestern Central School. Mr. Tyler explained that SWCS school officials have traffic safety concerns re children walking to the new elementary school located on Allegheny Ave in West Ellicott. Mr. Tyler and other Town of Ellicott officials will meet with representatives of the school to address the matter.

BUSINESS
Expansion of Greater Jamestown Empire Zone (GJEZ) – Tabled until the Sept. 18, 2002 meeting.
Proposed Local Law #3-2002 (Storm water Management) – The Town Council reviewed a proposed Local Law amending the Town of Ellicott code re storm water management.
Motion by Supervisor Tyler, seconded by Councilman Miller to schedule a Public Hearing for September 16, 2002 at 7:00 PM regarding a proposed amendment to the Town of Ellicott Storm Water Management code.

Adopt Sexual Harassment
Policy
Motion by Supervisor Tyler, seconded by Councilman Geisler to adopt a Sexual
Harassment Policy, which shall be mandatory for all Town of Ellicott
employees. (see ‘Sexual Harassment

Water Service on Camp St. Ext. – Highway Superintendent Shellhouse reported that the preliminary design work for the expansion of municipal water service to a section of Camp St. Ext. has been completed. He stated that he would be ordering pipe for the project soon.

Motion by Councilman Lodestro seconded by Supervisor Tyler to adopt revised
Procedures and Forms related to water and sewer service area

BAN (New
Dump Truck)
Motion by Supervisor Tyler, seconded by Councilman Lodestro authorizing the
issuance of a Bond Anticipation Note
in the amount of $57,600.00 for the purchase of a 2001 International Paystar with Dump Body for the Ellicott Highway

RESOLUTION #114-01
Ban Renewal (Water 1B)
Motion by Supervisor Tyler, seconded by Councilman Lodestro authorizing the
issuance and sale of a Bond Anticipation
Note in the amount of $28,200.00 for the construction of a Water
Supply and Distribution System for Water District 1B of the Town of Ellicott. (see
'BAN' file for detail)
Increase Senior Citizen Tax Exemption –
The Town Council discussed a letter from the Town of Ellicott Assessor
requesting an increase in the tax exemption for Senior Citizens residing in the
Town of Ellicott.
Motion by Councilman Lodestro seconded by Councilman Miller to increase
the annual senior citizen tax exemption from $11,000.00 to $12,000.00, effective
fiscal year 2004 and; further, to increase the tax exemption by $500.00 in each
of the four (4) subsequent fiscal years, terminating in fiscal year 2008 with
an exemption of $14,000.00.

Retirement Incentive Program –
Supervisor Tyler reported that the N.Y. State & Local Retirement Systems
recently announced a retirement incentive
program for local government employees.
He noted that two (2) Town of Ellicott employees are eligible for the
incentive. Mr. Tyler explained that the
Town of Ellicott must enact a local law to adopt the incentive. Consequently, a Public Hearing
must be held.
Motion by Supervisor Tyler,
seconded by Councilman Miller to schedule a Public Hearing for August
29, 2002 at 12:00 PM "to adopt a retirement incentive program for
eligible Town of Ellicott employees in accordance with Chapter 69, Laws of 200,
of the New York State Retirement System.”
RESOLUTION #116-02
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Geisler to pay 2002 current claims #994-1058,
inclusive, in the amount of $38,809.82 and charge to the proper fund or
account.
