Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
August 15,
2005 at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Miller, seconded by Councilman Heintzelman to accept the minutes
of the August 1, 2005 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the
following items into the record:
1.
Notification
of liquor license renewal: Fountain Bowl, 3316 Fluvanna Ave.
2.
Notification
of liquor license renewal: American Legion Post #777, Celoron.
3.
Notification
of liquor license renewal: La Scala Restaurant, 3202 Fluvanna Ave.
4.
Letter
from Women’s Services of Chautauqua Co. re the annual “Walk for Life.
5.
Notice
from the Chautauqua Co. Industrial Development Agency re an upcoming
Public Hearing to consider tax abatement for Jamestown Advanced Products
Corp.
6.
Letter
of thanks from Tanglewood Manor employees for the Town’s assistance in
having a traffic light installed on Fairmount Ave. in front of their facility.
7.
Notification
from NYS Dept. of Transportation that a traffic study will be conducted
in response to the Town’s request to reduce the speed limit on Ross Mills Road.
TOWN OFFICERS’ REPORTS
Attorney Lasker reported that he is working with Town of
Ellicott Police Chief William Ohnmeiss concerning a request to provide a School
Resource Officer (SRO) at Falconer Central School. Mr. Lasker noted that he is in the process of drafting a
tentative contract with the school re the proposed SRO service. He addressed several concerns pertaining to
the matter.
OLD BUSINESS
Local Waterfront Revitalization Program –
Town Clerk Erlandson reported that Chautauqua Co. Planning Dept.
officials will meet with the Town Council on Aug. 29, 2005 at 5:30 PM to
discuss in detail a proposed Lake
Waterfront Revitalization Program.
Library Taxing District – The Council discussed a proposal to create a special
library-taxing district
for the James Prendergast Library located in Jamestown. (Minutes 7/18/05 et. seq.) The Town Council expressed a number of
concerns re the proposal. Councilman
Geisler pointed out that a public referendum
on the matter will be conducted on Sept. 20, 2005. However, Mr. Geisler feels that the referendum is being conducted
too hastily. In his opinion, the vote
should be delayed until the public has had an opportunity to review the
ramifications of creating the new district and make an informed decision re the
matter. He noted that many Town of
Ellicott residents have expressed serious concerns about the proposal. He requested that the library board postpone
the referendum until Spring 2006.

Motion by Councilman Geisler, seconded by Councilman
Heintzelman requesting the James Prendergast Library Board to postpone a proposed Public
Referendum scheduled for September 20,
2005 regarding the creation of a library-taxing district
until May 2006.
Motion
by Supervisor Tyler, seconded by Councilman Miller to schedule a Public
Hearing for September 19, 2004 at 7:00 PM on an introductory Town of
Ellicott Local Law “increasing the term of office for the Ellicott Town Clerk from two (2)
years to four (4) years subject to a vote of the electors of the Town of
Ellicott.”

Motion by Supervisor Tyler, seconded by Councilman
Pickett authorizing the Town of Ellicott Supervisor to make the following
budget appropriations:
Appropriate the amount of $50,000.00 to Account #DB8540.4
(Drainage); appropriate the
amount of $3,462.16 from Unanticipated Revenues to Account #B8010.1 (Zoning –
Personal Services); appropriate the
amount of $3,462.16 from Unanticipated Revenues to Account #B8020.1 (Planning –
Personal Services); appropriate the
amount of $3,916.41 from Unanticipated Revenues to Account #B3620.1 (Safety
Inspection – Personal Services); appropriate the
amount of $5,654.84 from Unanticipated Revenues to Account #B9060.8 (Medical
Insurance).

RESOLUTION #86-05
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Pickett to pay 2005
current claims #897-946, inclusive, in the amount of $65,446.79 and charge
to the proper fund or account.
