Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

August 7, 2006 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Geisler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson. 

 

Absent: Highway Superintendent Shellhouse.

 

Supervisor Tyler opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

 

Motion by Councilman Miller, seconded by Councilman Pickett to accept the minutes of the July 17, 2006 meeting as presented by the Town Clerk.

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

                                   

1.      Notification of liquor license renewal: Henry Mosher Post, American Legion, Falconer, New York.

2.      Notice of an upcoming conference sponsored by Southern Tier West Regional Planning & Development Board re wind power.

3.      Notice from the Village of Falconer re an upcoming Public Hearing.

2.      Notice from Women’s Services of Chautauqua County re the annual “walk for life” to be held on Sept. 17, 2006.

3.      Notice of an upcoming teleconference re energy costs.

4.      Newsletter: So. Tier West.

5.      Newsletter: Chautauqua Co. Chamber of Commerce.

 

TOWN OFFICERS’ REPORTS

 

Councilman Heintzelman expressed concerns about traffic safety at the intersection of Baker St. Ext. & Southwestern Dr.  He noted that a number of accidents have occurred at the intersection.  Town officials will request the Chautauqua Co. Dept. of Public Works to look into the matter.

 

Councilman Geisler reported on the progress of improvements currently underway at Tanglewood Manor on Fairmount Ave.  He stated that the project is going well and will enhance the aesthetics of the property.  He noted that the upgrades include a walking path, benches & pavilion as well as several ponds.  He added that Tanglewood officials would be conducting an “open house” on Sept. 14, 2006.

 

Mr. Geisler also reported that the Ellicott Zoning Commission would be conducting its first meeting on Thursday, Aug. 10, 2006 at 3:30 PM.  (Minutes 5/15/06)

 

Supervisor Tyler expressed his concerns re recent decisions by the Ellicott Zoning Board of Appeals – particularly in regards to Tanglewood Manor.  In his opinion, the ZBA has been too restrictive with respect to granting permission to Tanglewood officials to expand their facility.  Councilman Geisler defended the ZBA.  He feels that the ZBA is just doing its job protecting the neighborhoods.

 

Town Clerk Erlandson reported that Highway Superintendent Shellhouse informed him that the Jamestown Board of Public Utilities would begin installing a new municipal water line to Tanglewood Manor on Friday, Aug. 11, 2006.  (Minutes 7/17/06)

 

SPECIAL REPORT re Weed Management in Chautauqua Lake (Karen Rine)

 

Karen Rine, President, Chautauqua Lake Partnership, updated the Town Council on the progress of weed management in Chautauqua Lake.  She reminded the Town Council that she represents the CLP on the new Chautauqua Lake Management Commission.  She stated that the commission is considering applying herbicides to the lake as part of a comprehensive weed management program.  However, she explained that the NYS Dept. of Environmental Conservation will not issue a herbicide permit until an Environmental Impact Study has been completed.  Ms. Rine noted that the CLMC hopes to complete the EIS in 2007.  The commission then plans on applying for a herbicide permit in 2008.  She praised the efforts of the CLMC to date.  She stated that the commission has done an exemplary job in regards to merging the various lake associations into a single entity.  According to Ms. Rine, all the groups in the commission are cooperating with each other.  She noted that the commission intends to apply for grant funding.  In addition, CLMC representatives will be meeting with the Chautauqua County Legislature later this month to request that funding be allocated annually for the commission in the Chautauqua Co budget.  She asked the Council to support county funding for the commission.

 

OLD BUSINESS

 

Drainage Study (Bentley Ave.) – The Town Council reviewed a cost estimate from Tolman Engineering, PLLC to prepare a drainage study of the northern end of Bentley Ave.  The cost of the study would be $20,650.00.  Tabled pending further review.  (Minutes 6/19/06)

 

Water Pump Station in School Ave. Area – Town Clerk Erlandson reported that a survey has been completed in preparation for a new water pump to be installed in the School Ave. area.  (Minutes 7/17/06)  The survey will be forwarded to Tolman Engineering, PLLC.

 

NEW BUSINESS

 

Cleaning of Burtis Bay Creek – Supervisor Tyler reported that he intends to ask Highway Superintendent Shellhouse about the possibility of cleaning a section of Burtis Bay Creek.

 

RESOLUTION #72-06

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Geisler to pay 2006 current claims #825-907, inclusive, in the amount of $31,818.48 and charge to the proper fund or account.
