Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
August 5, 2002
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Lodestro, Councilman Taylor, Deputy Town Clerk Pierce, Attorney Lasker, Highway Superintendent Shellhouse, Legislator Spicer.
Absent: Councilman Geisler, Councilman Miller, Town Clerk Erlandson.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Deputy Town Clerk Pierce called the roll.
APPROVAL OF MINUTES
Motion
by Councilman Lodestro, seconded by Councilman Taylor to accept the minutes of
the July 15, 2002 meeting as presented by the Town Clerk.
Deputy Town Clerk Pierce read the
following items into the record:

from Village of Falconer Highway Superintendent Anthony Cavallaro thanking the
Ellicott Highway Dept. for its assistance in cleanup operations following a
recent storm.
TOWN OFFICERS’ REPORTS
Councilman Lodestro reported that he received several phone calls re drainage problems, specifically, in the Lewis Street area. Mr. Lodestro, Highway Supt. Shellhouse & Legislator Spicer discussed whether the problem is a Town or County responsibility. Mr. Shellhouse stated that he would contact the Co. if he needs assistance in alleviating the drainage problem.
Attorney Lasker reported that he recently attended a meeting of the Ellicott Drainage Committee. He stated that the committee addressed the current policy concerning ditches. He also noted that the committee directed him to draft an amendment to the Ellicott code re storm water management. He will distribute the draft at the Aug. 19, 2002 Town Council meeting.
Highway Superintendent Shellhouse reported that an individual conducting logging operations in the Fluvanna area might have encroached onto property within Fluvanna Park that is owned by the Town of Ellicott. He recommended that a survey of Fluvanna Park be conducted. Mr. Shellhouse will look into the matter further.
Mr. Shellhouse also reported that he recently closed the 7th Street Bridge in Celoron. He stated that he contacted Abate Engineering to examine the bridge.
Mr. Shellhouse reported on the status of the Lyndon Blvd Reconstruction project. He noted that a change order would be submitted re repair of a sewer line damaged by tree roots.
Supervisor Tyler reported that the Economic Development Zone would be altering its boundaries. Representatives from EDZ will attend the Aug. 19, 2002 Town Council meeting to discuss the matter.
Mr. Tyler also reported that the Town of Ellicott recently received Sales Tax reimbursement monies from the New York State. He stated that the total sales tax reimbursement received to date is $674,912.48 & noted that the 2002 amount is 0.05% higher than what was received last year. Mr. Tyler also pointed out that the budgeted amount is $887,070.88.

BUSINESS
Sexual Harassment Policy – The Town Council
reviewed a proposed Sexual Harassment Policy drafted by Town Attorney Lasker. Mr. Lasker briefly discussed the policy and
stated that he would also review a copy of a Sexual Harassment Policy currently
in effect at the Town of Ellicott Police Dept.
Mr. Lasker urged the Council to adopt a Sexual Harassment Policy as soon
as possible. Tabled until the Aug. 19,
2002 meeting.
Water Service on Camp St. Ext. – Highway Superintendent Shellhouse reported that a survey of the service area is nearly completed. Councilman Lodestro reported that Attorney Greg Yaw attempted to pursue a low interest loan for the Camp Street Water project. However, Mr. Yaw advised that the Council should not pursue the matter at the present time.
NEW BUSINESS
Burtis Bay Milfoil Problem – Supervisor Tyler
reported that Save Our Lake Environment (SOLE) recently placed a notice
in the Jamestown Post Journal asking anyone who became ill as a result
of the recent herbicide application
in Burtis Bay to notify SOLE.
Mr. Tyler noted that no illnesses were reported. Superintendent Shellhouse stated that the
Ellicott Highway Dept. would be picking up weeds along the Burtis Bay
shoreline. Legislator Spicer asked
about the status of bringing together the various lake organizations to discuss
long-term management of
Chautauqua Lake. Mr. Tyler
stated that N.Y. State Senator Patricia McGee is pursuing the matter.
Purchase of Used Water Truck – Highway Superintendent Shellhouse requested permission to
purchase a used 1996 truck from the Town of Carroll at a cost of
$8,025.00. Mr. Shellhouse stated that
the truck has only 29,834 miles & would be used for maintenance of Town of
Ellicott water service areas.

Purchase of Used Water Truck
Motion by
Councilman Lodestro, seconded by Supervisor Tyler authorizing the purchase of a
used 1996 water truck
from the Town of Carroll at a cost
to the Town of Ellicott of $8,025.00.
RESOLUTION #110-02
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Taylor to pay 2002 current claims #943 - #993,
inclusive, in the amount of $49,692.34 and charge to the proper fund or
account.
