Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

August 1, 2001 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Hendrickson, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Duncanson, Code Enforcement Officer Woodbury, Legislator Spicer.

 

Supervisor Tyler opened the meeting at 7:00 P.M. and led the Town Council in the Pledge of Allegiance.  Town Clerk Erlandson called the roll.

 

PRIVILEGE OF THE FLOOR

 

Legislator Spicer reported that Chautauqua County recently took over two bridges in the Town of Ellicott: the Dow St. Bridge & a bridge on the Wilson Hollow Road.

            Town Clerk Erlandson read the following items into the record:

OLD BUSINESS

 

Buffalo-Willard Water Project Engineer Rex Tolman reported that the installation of a new water service area in the Buffalo-Willard St. Ext. area has been completed.  He noted that some minor property restoration remains to be conducted.  However, he assured the Council that the restoration work will be finished by the end of the year.  Mr. Tolman stated that the total cost of the project was $947,527.00.  Therefore, the cost to each of the 177 homeowners in the service area will be approximately $5,353.00.

 

Lyndon Blvd. Reconstruction Project - Tabled pending further review.

 

Renovation of Administration Building – Mr. David Walter, Habiterra Design Group, presented a bid recommendation letter re the renovation of the Ellicott Administration Building.  He noted that bids were returned on July 24, 2001 at 2:00 PM.  A total of thirteen (13) bids were received for five contracts.  Mr. Walter stated that the electrical bids received were considerably higher than expected.  However, Mr. Walter explained that he met with the apparent low bidder for the electrical contract and determined that certain modifications could be made to reduce the cost of the electrical contract.  He recommended that the Council award the bids as specified in his letter, including a change order re the electrical contract.  He estimated the total cost of the project to be $488,657.00 (including the reduced electrical contract).

 

RESOLUTION 105-01

Award Bids (Renovation of Administration Building)

 

Motion by Councilman Hendrickson, seconded by Councilman Lodestro to award the following bids for the renovation of the Ellicott Administration Building located at 215 South Work St., Falconer, N.Y. pending a change order regarding the electrical bid (see ‘Building Renovation’ file for detail):

 

Asbestos Abatement - MCS Remedial, Orchard Park, N.Y. -  $13,390.00

General Construction - Remco Construction Co. Inc., Warren, Pa. - $249,400.00

Heating/Ventilating – King’s Heating & Sheet Metal Inc., Falconer, N.Y. - $72,750.00

Electrical – Ahlstrom-Schaeffer Inc., Jamestown, N.Y.  - $114,500.00 (NOTE: change    order pending)                                                     

            Plumbing – RD Controls & Mechanical, Arcade, N.Y. - $22,017.00

Water and Sewer Service on Fluvanna Ave. Ext.  – The Town Council discussed the possibility of installing water & sewer service along Fluvanna Ave. Ext. (Rte. 430) between the Jamestown City Line and the Fluvanna Townline Rd.   Engineer Tolman suggested that the Town conduct a feasibility study re the project.  The Council asked Mr. Tolman to determine the cost of preparing a feasibility study.

 

NEW BUSINESS

 

Tire Cleanup (Elam Ave.) – Highway Superintendent Shellhouse asked the Town Council for permission to assist Chautauqua Co. with a tire removal operation on a property located on Elam Ave.  He noted that there are approximately 1,000 tires on the site.  Councilman Lodestro stated that the Ellicott Highway Dept. does not normally get involved with tire cleanups.  However, he explained that the Co. Health Dept. considers the tires to be a possible public health risk and should therefore be removed as soon as possible.  Attorney Duncanson noted that an easement would have to be obtained before the removal of the tires can begin.

 

RESOLUTION #106-01

Cleanup of Tires on Elam Ave.

 

Motion by Supervisor Tyler, seconded by Councilman Taylor authorizing the Town of Ellicott Highway Department to assist Chautauqua County personnel with a tire removal operation on a property located on Elam Ave.

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Miller, to pay current claims 898-947, inclusive, in the amount of $11,174.28 and charge to the proper fund or account.

RESOLUTION #108-01

Convene Executive Session (Pending Litigation: Smith)

 

Motion by Councilman Taylor, seconded by Councilman Lodestro to Convene Executive Session for the purpose of discussing pending litigation regarding the Town of Ellicott v. Smith matter.      7:42 – 8:55 PM

RESOLUTION #109-01

Settlement re Town of Ellicott v. Smith

 

Motion by Councilman Lodestro, seconded by Supervisor Tyler authorizing Councilman Taylor to appear in Chautauqua County Supreme Court on August 2, 2001 as a representative of the Town of Ellicott regarding the Town of Ellicott v. Smith litigation and, further; directing Councilman Taylor, on behalf of the Town of Ellicott, to enter into an agreement to resolve the Town of Ellicott v. Smith matter according to the terms stipulated in Executive Session and accepted by both parties.
