Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

July 18, 2001 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Hendrickson, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Duncanson.

 

Absent: Councilman Lodestro.

 

Supervisor Tyler opened the meeting at 7:00 P.M. and led the Town Council in the Pledge of Allegiance.  Town Clerk Erlandson called the roll.

 

PRIVILEGE OF THE FLOOR

 

Mr. Les Johnson, Vice President, Chautauqua Rails-To-Trails gave a presentation regarding the existing recreational trails in Chautauqua County.  He outlined plans to extend the trail system & explained that the project will be funded with grant monies and private donations.  He asked the Ellicott Town Council for a letter of support.

 

Mr. Cliff Catlin asked the Council about the possibility of installing water and sewer service along Fluvanna Ave. Ext.  He explained that he is the owner of commercial property on Fluvanna Ave. Ext. & that he and other property owners are in favor of installing water & sewer service.  Councilman Taylor will look into the matter.

               

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

 

1.      Letter from Choose Life of Jamestown, Inc. re the annual “walk-for-life” to be held in Sept. 2001.

2.      Notification of liquor license renewal at AMVETS Post 1996, 3334 Fluvanna Ave.

3.      Letter from Al Suchar, Chairman, Ellicott Zoning Board of Appeals requesting additional compensation for Zoning Board members.

4.      Letter from the New York State Retirement Systems re annual contributions.

5.      Newsletter: Chautauqua Co. Soil & Water Conservation District.

6.      Newsletter: Chautauqua Watershed Conservancy, Inc.

7.      Police Activity Report: May 2001.

 

TOWN OFFICERS’ REPORTS

 

Councilman Hendrickson expressed his concern that the new sign code is not being enforced.  He asked Supervisor Tyler to look into the matter.

 

Mr. Hendrickson reported that the Town of Ellicott is eligible for reimbursement of certain computer hardware & software purchased in 2002 through the community GIS program.  He noted that Southern Tier West Regional Planning & Development Board administers the program.  He explained that STW has asked for a letter of commitment to the program for 2002.  Mr. Hendrickson stated that he has drafted the letter and asked Supervisor Tyler to sign it.

 

Mr. Hendrickson expressed his concerns that the Chautauqua Lake Waterfront Revitalization Project is moving too slowly.

 

Mr. Hendrickson stated that he met with the developer of a proposed hotel to be constructed near the intersection of Rte. 60 & I-86.  He reported that preliminary phases of the project are moving ahead.

 

Town Clerk Erlandson reported that the Town of Ellicott received two (2) grants from the New York State Education Dept. through the Local Government Records Management Improvement Fund.  A grant in the amount of $3,246.00 involves establishing a records retention schedule for the Ellicott Town Clerk’s office.  A second grant in the amount of $8,358.00 will be used towards the renovation of the third floor of the Ellicott Administration Bldg.

 

Attorney Duncanson commented on a letter from Moonbrook Country Club officials asking for assurances from the Town of Ellicott that the country club’s property assessment will not be increased as a result of the recent rezoning of Rte. 60.  He asked Supervisor Tyler to draft a letter to Moonbrook officials stating that the Town will not raise the assessment.

 

Highway Superintendent Shellhouse reported that he and Councilman Taylor will look into a matter involving the possible erosion of property on Denslow Ave.

 

Supervisor Tyler reported that he received a letter from Village of Celoron officials concerning the high number of accidents on Rte. 394 in front of Sam’s Club.  Mr. Tyler noted that the Village is requesting the N.Y. State Dept. of Transportation to install a traffic light at the location.

 

OLD BUSINESS

 

Lyndon Blvd. Reconstruction Project - Tabled pending further review.

 

Renovation of Administration Building – Councilman Hendrickson reported that the return date for bids for the renovation of the Ellicott Administration Bldg. has been changed to July 24, 2001 at 2:00 PM.

 

NEW BUSINESS

 

RESOLUTION #101-01

Waive Fees (Fluvanna Library)

Motion by Councilman Taylor, seconded by Councilman Hendrickson to waive all fees incurred regarding the construction of a new sign at Fluvanna Free Library.

RESOLUTION #102-01

Transfer of Funds from Bank Account (Justice Jackson)

 

Motion by Supervisor Tyler, seconded by Councilman Hendrickson requesting HSBC Bank to release all Town of Ellicott Justice bank accounts in the name of Honorable Edward Jackson, deceased Town of Ellicott Justice, to Patrick A. Tyler, Supervisor and Chief Fiscal Officer of the Town of Ellicott.

Adopt New Retirement Plan – Town Clerk Erlandson pointed out that in accordance with the 2001-2002 CSEA Labor Agreement the Town of Ellicott must adopt Section 75-i of the N.Y. State Retirement Plan.  Mr. Erlandson noted that during the current fiscal year there would be no additional annual cost to implementing the plan.

 

RESOLUTION #103-01

Adopt New Retirement Plan

 

Motion by Supervisor Tyler, seconded by Councilman Miller to adopt Section 75-i of the New York State Retirement & Social Security Law as stipulated in the 2001-2002 Labor Agreement between the Town of Ellicott and CSEA Employees.  (see ‘Retirement – Misc.’ file for detail)

            RESOLUTION #104-01

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Miller, to pay current claims 811-897, inclusive, in the amount of $141,367.34 and charge to the proper fund or account.

Motion by Councilman Miller, seconded by Supervisor Tyler to adjourn at 7:37 PM.
