Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
July 17, 2006
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Police Chief Ohnmeiss.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Miller, seconded by Councilman Heintzelman to accept the minutes
of the June 19, 2006 meeting as presented by the Town Clerk.
Town Clerk Erlandson read the
following items into the record:

Letter
from the NY Dept. of State that Town of Ellicott Local Law #2-2006 has
been received & filed.
2.
Newsletter:
Chautauqua Co. Chamber of Commerce.
3.
Falconer Fire Dept. Incident Report: May 2006.
TOWN OFFICERS’ REPORTS
Town Clerk Erlandson reported that a free rabies
vaccination clinic was conducted at the Ellicott Highway Garage on
Thursday July 13, 2006. He stated that
280 dogs and cats were vaccinated.
Highway Superintendent
Shellhouse reported
that he & Supervisor Tyler recently attended a Public Hearing re the
closing of the railroad crossing at Wicks Ave. in West Ellicott. He stated that a judge’s decision re the
matter is expected in the near future.
Supervisor Tyler reported that he attended a
meeting re the new traffic light at the intersection of Warwick & Fairmount
Ave. He noted that New York State
Senator Catherine Young attended the meeting as well as an official from the
NYS Dept. of Transportation. The
meeting was conducted to address residents’ concerns that area traffic patterns
have been altered as a result of the light.
However, according to the DOT official, traffic patterns have not
been adversely affected. Mr. Tyler
stated that he would ask the Ellicott Police Dept. to temporarily increase its
patrols in the area.
Dog Control Ordinance
(Proposed)
– Tabled until further notice.
Drainage Study (Bentley
Ave.) –
Highway Superintendent Shellhouse reported that Engineer Rex Tolman is
preparing a drainage study concerning the upper end of Bentley Ave. (Minutes 6/19/06).
RESOLUTION #64-06
Appointment to Planning Board (Thomas)
Motion by Councilman Geisler, seconded by Councilman
Heintzelman appointing Robert Thomas, 409 Hunt Rd., to
fill an unexpired term on the Town of Ellicott Planning Board; term to expire December
31, 2010.

Water Pump Station on School
Ave. –
Highway Superintendent Shellhouse updated the Town Council on the status of a
proposed new water pump station in the School Ave. area. Councilman Heintzelman asked Mr. Shellhouse
approximately when construction of the water pump would proceed. Mr. Shellhouse stated that he intends to
have the property surveyed as soon as possible. He will then present a cost estimate for the project.
Extension of Water Line
(Tanglewood Manor) – Supervisor Tyler reported that he received $8,825.00 from Tanglewood
Manor to extend a municipal water line. He explained that the new line would increase water capacity to Tanglewood’s
existing facility on Fairmount Ave. while also serving the proposed new senior
day care center. Highway Superintendent
Shellhouse stated that the new water line will run between existing water lines
on Merlin Ave. & Gifford Ave. He
added that the water line will be installed as soon as possible.
NEW BUSINESS
RESOULTION #65-06
Refund ZBA Application Fee (Bastian)
Motion by Supervisor Tyler, seconded by Councilman Geisler authorizing the
Town Supervisor to refund $75.00 (less expenses) to David & Sara
Bastian, 65 Houston Ave. for a Zoning Board of Appeals application fee
following the withdrawal of the application.

Motion by Supervisor Tyler, seconded by Councilman Geisler authorizing the
Town of Ellicott Supervisor to sign an agreement between the Town of
Ellicott and the Chautauqua Lake Association stipulating that the Town pay
the CLA the amount of $2,500.00 (two thousand five hundred dollars) for a lake
maintenance program conducted in 2006.

RESOLUTION #67-06
Appoint Full Time Police Officer (Pierce)
Motion by Councilman Miller, seconded by Councilman Pickett appointing Kevin
Pierce, 2210 Willard St. Ext., Jamestown, NY, as a full-time Town of Ellicott police officer, effective July 17, 2006
at an annual salary of $35,000.00 and subject to a one-year probation.
RESOLUTION #68-06
Hire Part Time Police Officer (Erickson)
Motion by Supervisor Tyler, seconded by Councilman Heintzelman appointing
Kevin M. Erickson, 28 Dunn Ave., Jamestown, New York as a part time Town of Ellicott Police Officer, effective July 17, 2006 at a starting rate of pay of $11.56 per hour and subject to a
one-year probation.
RESOLUTION #69-06
Shared
Highway Services Agreement
Motion by Supervisor Tyler, seconded by Councilman
Pickett authorizing the Town of Ellicott to participate in a Shared Services Highway Agreement with other
municipalities in Chautauqua County.

RESOLUTION #70-06
Budget Transfers
Motion by Supervisor Tyler,
seconded by Councilman Miller authorizing Town of Ellicott Supervisor to make
the following budget transfers:
Transfer the amount of $2,121.01 from Account #A1990.4 (Contingency) to Account #A1110.2 (Justice Court - Equipment).
RESOLUTION #71-06
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Pickett to pay 2006
current claims #687-824, inclusive, in the amount of $113,096.77 and charge
to the proper fund or account.
