Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

July 15, 2002 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Geisler, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Lasker.

 

Supervisor Tyler opened the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.  Town Clerk Erlandson called the roll.

 

APPROVAL OF MINUTES

 

Motion by Councilman Lodestro, seconded by Councilman Miller to accept the minutes of the July 1, 2002 meeting as presented by the Town Clerk.

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

 

1.      Letter from the New York State Police commending the Ellicott Police Dept. for its excellent assistance during a recent visit to the area by N.Y. Governor George Pataki.

2.      Notice of Public Hearing: Village of Falconer Zoning Board, July 24, 2002.

3.      Invitation to a dinner cruise on the Summer Wind for Chautauqua County elected officials.

 

TOWN OFFICERS’ REPORTS

 

Councilman Miller reported that he received a letter from an individual who is interested in conducting logging operations in Fluvanna Park.  Attorney Lasker will review the matter.

 

Attorney Lasker reported that he received a letter from the attorney for SBA and Horizon re the proposed construction of a telecommunications tower on Howard Ave.  Mr. Lasker noted that the companies are exploring “alternative designs that would eliminate the need for the proposed tower”.  He will keep the Council apprised of the situation.

 

Mr. Lasker also reported that K-Mart has filed a Notice of Petition against the Town of Ellicott re the company’s property tax assessment.  Mr. Lasker stated that he would review the matter with the Town of Ellicott Assessor.

 

Highway Superintendent Shellhouse reported that he received a notice re an unsafe tree on Avalon Blvd.  Mr. Shellhouse will address the matter.

 

OLD BUSINESS

 

Human Resource Analysis – Councilman Geisler suggested that the Town of Ellicott not proceed with a comprehensive Human Resource Analysis.  As an alternative, Mr. Geisler recommended that a management assessment be conducted.  He will contact AMTEK officials to determine the feasibility & cost of such an assessment.

 

Renovation of Lyndon Blvd. - Chautauqua Co. Senior Project Coordinator Rose Wightman updated the Town Council re the status of the Lyndon Park Road & Infrastructure Improvement Project (‘Minutes 1/17/01’ et. seq).  Supervisor Tyler signed a voucher requesting that Chaut. County’s release its share of the funding for the project.

 

Water Service on Camp St. Ext. – Highway Superintendent Shellhouse stated that the required survey for the project will be conducted soon.

 

Water Service on Orchard Rd.Supervisor Tyler reported that Town of Busti officials are not sure whether the proposed water line on Baker St. Ext. could be installed in 2002 as originally scheduled.  (‘Minutes 1/1/02’ et. seq.)  Mr. Tyler explained that the installation of the proposed water line on Orchard Rd. is contingent upon the installation of the Baker St. line.  Tabled until further notice.

 

NEW BUSINESS

 

Sexual Harassment Policy – Attorney Lasker noted that each Council member recently received a copy of the Sexual Harassment Policy currently in effect for Chautauqua Co. employees.  He requested that the Council review the policy.  He recommended that the Town of Ellicott adopt a sexual harassment policy as soon as possible.  He pointed out that the County policy could be amended for implementation in the Town of Ellicott.

 

RESOLUTION #107-02

Budget Transfers

 

Motion by Supervisor Tyler, seconded by Councilman Geisler authorizing Town of Ellicott Supervisor to make the following transfers:

 

Transfer the amount of $814.79 from Account #A9010.8 (State Retirement) to Account #A1110.4 (Justice – Contractual); transfer the amount of $440.00 from Account #A9010.8 (State Retirement) to Account #A1410.4 (Town Clerk – Contractual); transfer the amount of $1,013.78 from Account #A9010.8 (State Retirement) to Account #A1420.4 (Attorney – Contractual); transfer the amount of $58.56 from Account #A9010.8 (State Retirement) to Account #A3610.4 (Examining Board – Contractual); transfer the amount of $438.01 from Account #A9010.8 (State Retirement) to Account #A3510.4 (Dog Control – Contractual).

RESOLUTION #108-02

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Taylor to pay 2002 current claims #862-942, inclusive, in the amount of $283,843.21 and charge to the proper fund or account.
