Minutes of a Special Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

June 7, 2006 at 12:00 P.M.

 

Present: Supervisor Tyler, Councilman Pickett, Councilman Heintzelman, Town Clerk Erlandson, Code Enforcement Officer Woodbury.

 

Absent: Councilman Geisler, Councilman Miller.

 

Supervisor Tyler opened the meeting at 12:08 PM.  Town Clerk Erlandson called the roll. 

 

APPROVAL OF MINUTES

 

Motion by Councilman Heintzelman, seconded by Councilman Pickett to accept the minutes of the May 15, 2006 meeting as presented by the Town Clerk.

TOWN OFFICERS REPORTS

 

Supervisor Tyler reported that he received a letter from Penny Gleason, CSEA Labor Relations Specialist, stating that the CSEA wishes to commence negotiations for a new Labor Agreement for Town of Ellicott Highway & Office employees.  The Labor Agreement would be effective January 1, 2007.

 

OLD BUSINESS

 

Accept Bids for Highway Materials & Services (Gas & Diesel Fuel)Tabled until further notice.

 

Dog Control Ordinance (Proposed)Tabled pending further review.

 

Local Law #2-2006 (Renewal Periods of Special Use Permits)Supervisor Tyler noted that due to the cancellation of the Regular Town Council meeting scheduled for June 5, 2006, the Public Hearing concerning the renewal periods of special use permits must be re-scheduled.       (see Minutes May 15, 2006)

 

Motion by Supervisor Tyler, seconded by Councilman Pickett to schedule a Public Hearing for June 19, 2006 at 7:00 PM re introductory Town of Ellicott Local Law #2-2006 allowing the Ellicott Zoning Board of Appeals to extend the renewal periods of special use permits.

Water Pump Station on School Ave. – Code Enforcement Officer Woodbury explained that a section of Homestead Ave. must be conveyed (i.e. deeded) to the Town of Ellicott before a proposed water pump station could be constructed in the School Ave. area.  He added that a Public Hearing must be held prior to the conveyance.

 

Motion by Supervisor Tyler, seconded by Councilman Pickett to schedule a Public Hearing for June 19, 2006 at 7:00 PM authorizing and directing the Town of Ellicott Supervisor to terminate any and all public highway rights to a 100x50 foot section of Homestead Ave. south of Glenwood Ave. and to convey this parcel by ‘quit-claim’ deed to Town of Ellicott Water District #1.

NEW BUSINESS

 

Motion by Supervisor Tyler, seconded by Councilman Heintzelman to cancel the Regular Town Council meeting scheduled for July 3, 2006 in conjunction with the Independence Day holiday.

Vacancy on Planning Board – Town Clerk Erlandson reported that Michael Mogenhan, 67 School Ave. recently resigned from the Ellicott Planning Board.  Mr. Erlandson noted that Mr. Mogenhan’s term does not expire until Dec. 31, 2010.  He distributed a list of candidates who, in the past, have expressed interest in serving on the Planning Board.  The Council asked Clerk Erlandson to contact the individuals to determine whether they are still interested in serving on the board.

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Pickett to pay 2006 current claims #578-633, inclusive, in the amount of $39,663.24 and charge to the proper fund or account.
