Minutes of a Regular Meeting of the

Town Council of the Town of Ellicott

held at the Administration Building,

215 S. Work Street, Falconer, N.Y. on

May 16, 2001 at 7:00 P.M.

 

Present: Supervisor Tyler, Councilman Hendrickson, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Duncanson, Police Chief Vanstrom.

 

Supervisor Tyler opened the meeting at 7:00 P.M. and led the Town Council in the Pledge of Allegiance.  Town Clerk Erlandson called the roll.

 

APPROVAL OF MINUTES

 

Councilman Hendrickson requested that the minutes of the May 2, 2001 meeting be amended re comments made by Legislator Spicer concerning the former National Car Rental Service located within the Airport Industrial District.

 

Motion by Supervisor Tyler, seconded by Councilman Lodestro to accept the amended minutes of the May 2, 2001 meeting as presented by the Town Clerk.

CORRESPONDENCE

 

            Town Clerk Erlandson read the following items into the record:

 

1.      Notification re the Annual Open House at the Jamestown Airport on June 16 & 17, 2001.

2.      Notice of an upcoming teleconference re retirement benefits.

3.      Falconer Fire Dept. Incident Report: April 2001.

 

TOWN OFFICERS’ REPORTS

 

Councilman Miller reported that the Town of Ellicott-Village of Falconer committee on shared services met on May 7, 2001.   The committee determined that it would not be feasible for the Town to re-locate its offices to the Village of Falconer Community Building. 

 

Mr. Miller also reported that the Ellicott Insurance Committee will meet on May 18, 2001.

 

Councilman Lodestro reported that he met with Engineer Rex Tolman and Highway Superintendent Shellhouse re the Buffalo-Willard Water Project.  He noted that the project is nearly complete.  Mr. Lodestro stated that the estimated final cost of the project would be $874,905.00.  He suggested that the each resident be notified when the final cost has been determined to explain the available options for repaying the Town.

 

Mr. Lodestro also reported that he recently met with Attorney Greg Yaw re several matters.  He explained that Attorney Yaw recommended that the Town of Ellicott adopt a specific policy re the establishment of water & sewer districts.  Mr. Yaw has agreed to draft a policy for a cost of approximately $2,000.00.

 

RESOLUTION #86-01

                Policies and Procedures for the Establishment of Water & Sewer Districts

 

Motion by Supervisor Tyler, seconded by Councilman Taylor to retain Attorney Gregory Yaw for the purpose of drafting polices and procedures concerning the establishment of water and sewer districts in the Town of Ellicott, at a cost not to exceed $2,000.00.

Attorney Duncanson stated that street intersections with ‘STOP’ signs should be designated in the Town of Ellicott code.

 

Mr. Duncanson also reported that Motel 6 has agreed to settle an assessment dispute.  He noted that the Town of Ellicott Assessor approves of the proposed settlement.  He asked the Council for permission to resolve the matter.

 

RESOLUTION #87-01

                Settlement of Assessment Matter (Motel 6)

 

Motion by Supervisor Tyler, seconded by Councilman Hendrickson authorizing Attorney William Duncanson to resolve an assessment matter concerning Motel 6 located on East Main Street.

Highway Superintendent Shellhouse reported that two new ‘STOP’ signs have been installed on Westminster Circle and Magnolia Ave.  (see ‘Minutes – 5/2/01’)

 

Chief Vanstrom reported that he has compiled a new police manual for the Ellicott Police Dept.  He invited the Council to review the manual.

 

Mr. Vanstrom also reported that he donated used Town of Ellicott Police Uniforms to the Village of Franklinville, NY.  He read a letter from Village of Franklinville officials thanking him for the uniforms.

 

OLD BUSINESS

 

Lyndon Blvd. Reconstruction Project – Councilman Lodestro commented on a letter received from Attorney Gregory Yaw re several aspects of the proposed project.  Mr. Lodestro noted that the grant monies needed to finance the project would not be available until the New York State Budget has been adopted.  He also stated that the Town could receive an interest-free loan to finance its share of the project.  Tabled pending further review.

 

Renovation of Administration Building – Tabled pending further review.

 

Bridge Repair (Old Fluvanna Rd.) – Highway Superintendent Shellhouse reported that Engineer Ralph Abate has load-rated the bridge on Old Fluvanna Rd. at ten tons.  However, Mr. Shellhouse noted that the bridge railing and underpinning would still need to be repaired.

 

NEW BUSINESS

 

RESOLUTION #88-01

Re-number Local Law #9-2000 (Rte. 60 Rezoning)

 

Motion by Councilman Hendrickson, seconded by Councilman Miller to re-number Town of Ellicott Local Law #9-2000 to Local Law #8-2000 in compliance with New York State Department of State regulations.

Schedule Work Session re Funding of Town Projects – Supervisor Tyler scheduled a work session for May 22, 2001 at 6:00 PM to discuss the funding of proposed Town Projects.

 

Subdivision on West Oak Hill Rd. – Councilman Taylor reported that two local developers are interested in building a new subdivision on West Oak Hill Rd. near Moonbrook Country Club.  Mr. Taylor explained that the developers have asked the Town of Ellicott for assistance in installing water & sewer service to the property.  He stated that the developers want the Ellicott Town Council to establish a water/sewer service area within the proposed subdivision.  Attorney Gregory Yaw advised Councilman Taylor that the developers do not require the Town’s assistance, since the water and sewer lines will only be serving a private development.  Therefore, a service area is not necessary at the present time.  Councilman Taylor noted that the developers could circulate a petition to determine if other residents are willing to share the cost of installing the water and sewer lines.  Upon receiving a petition the Town would then consider establishing a service area.  Mr. Taylor stated that he would discuss the options with one of the developers.

 

RESOLUTION  #89-01

STOP-DWI Contract

 

Motion by Councilman Lodestro, seconded by Councilman Miller authorizing the Town of Ellicott Supervisor to sign a contract between the Town of Ellicott and Chautauqua County regarding STOP-DWI services.  (See ‘STOP-DWI’ file for detail)

Payment of Claims

 

Motion by Supervisor Tyler, seconded by Councilman Taylor, to pay current claims 554-637, inclusive, in the amount of $60,235.05 and charge to the proper fund or account.

RESOLUTION #91-01

Convene Executive Session (Pending Litigation: Lee)

 

Motion by Supervisor Tyler, seconded by Councilman Miller to Convene Executive Session for the purpose of discussing personnel matter involving the Town of Ellicott Code Enforcement Officer.      7:45 – 8:37 PM

RESOLUTION #92-01

Establish Permanent Position (Woodbury)

 

Motion by Supervisor Tyler, seconded by Councilman Miller to suspend the probationary period of Ellicott Code Enforcement Officer Randy Woodbury and change his status to permanent employee of the Town of Ellicott in compliance with New York State Civil Service regulations, effective May 17, 2001.
