Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
May 2, 2001 at
7:00 P.M.
Present: Supervisor Tyler, Councilman Hendrickson, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse, Attorney Duncanson, Police Chief Vanstrom, Legislator Spicer.
Supervisor Tyler opened the
meeting at 7:00 P.M. and led the Town Council in the Pledge of Allegiance. Town
Clerk Erlandson called the roll.
Motion
by Councilman Miller, seconded by Councilman Taylor to accept the minutes of
the April 18, 2001 meeting as presented by the Town Clerk.
PRIVILEGE OF THE FLOOR
Legislator Spicer commented on the proposed
new countywide community college charge-back system. In his opinion, the current system was not equitable.
Mr. Spicer also questioned the zoning
designation of the former National Car Rental Service located in the Airport
Industrial District.
Town Clerk Erlandson read the
following items into the record:
1.
Notice
re the Annual Southern Tier West Local Government Conference to be held May 10,
2001.
2.
Notification
from Falconer American Legion that the Annual Falconer Memorial Day Parade has
been cancelled.
3.
Newsletter:
Community Assistance Program.
4.
Notice
of an upcoming teleconference re retirement benefits.
TOWN OFFICERS’ REPORTS
Councilman
Miller reported that the Town of Ellicott-Village of Falconer committee on
shared services met on April 23, 2001.
A second meeting is scheduled for May 7, 2001.
Councilman
Taylor asked that a work session be scheduled re funding for proposed Town
projects. Mr. Taylor feels that the
projects need to be prioritized.
Supervisor Tyler will schedule a work session during the May 16, 2001 Town
Council meeting.
Highway
Superintendent Shellhouse reported he received a letter from the Chautauqua
County DPW re four bridges in the Town of Ellicott that the County plans on
taking over.
Mr.
Shellhouse noted that several new homes are going to be constructed within the
Buffalo-Willard Water Service Area. He
asked the Council for direction re the process for getting the new homes
connected to the water line.
Lyndon Blvd. Reconstruction Project – Councilman Lodestro reported that Attorney Gregory Yaw is looking into the establishment of a special taxing district in the Lyndon Blvd. area. Mr. Lodestro also noted that the Town might be granted an interest-free loan to finance its share of the project.
Renovation of Administration Building – Tabled until the May 16, 2001 meeting.
NEW BUSINESS
Bridge Repair (Old Fluvanna Rd.) –
Highway Superintendent Shellhouse hopes to have an engineering report on the
bridge by the May 16, 2001 Council meeting.
He noted that the Ellicott Highway Dept. might be able to make several
minor repairs to the bridge that would allow it to remain open and fully
functional.
RESOLUTION #82-01
Install
New Stop Sign (Magnolia & Brooks)
Motion by Councilman Lodestro, seconded by
Supervisor Tyler authorizing the installation of a “stop” sign
on Magnolia Avenue at Brooks Avenue in West Ellicott, contingent upon approval
from the Chautauqua County Director of Public Works and subject to New York
State traffic regulations.

RESOLUTION #83-01
Install

Motion by Councilman Hendrickson, seconded by
Councilman Miller authorizing the installation of a “stop” sign
on Westminster Circle at Canterbury Rd. in West Ellicott, contingent upon approval
from the Chautauqua County Director of Public Works and subject to New York
State traffic regulations.

RESOLUTION #84-01
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Miller, to pay current claims 505-551, inclusive, in
the amount of $28,617.49 and charge to the proper fund or account.

RESOLUTION #85-01
Convene Executive Session (Pending Litigation: Lee)
Motion
by Supervisor Tyler, seconded by Councilman Hendrickson to Convene Executive Session for the purpose of discussing pending
litigation re the Town of Ellicott v. Dennis Lee matter. 7:40 – 7:45 PM
