Minutes of a Regular Meeting of the
Town Council of the Town of Ellicott
held at the
Administration Building,
March 20, 2006
at 7:00 P.M.
Present: Supervisor Tyler, Councilman Geisler, Councilman Pickett, Councilman Miller, Councilman Heintzelman, Town Clerk Erlandson, Highway Superintendent Shellhouse, Legislator Spicer.
Supervisor Tyler opened the
meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance. Town Clerk Erlandson called the roll.
Motion
by Councilman Miller, seconded by Councilman Heintzelman to accept the minutes
of the March 6, 2006 meeting as presented by the Town Clerk.
Mr. Benjamin Haskins, 1982 Peck-Settlement
Rd. commented on the number of drug-related arrests made throughout Chautauqua
Co. in 2004 & 2005.
Legislator Spicer reported that he looked into
a request made by Ellicott Town Councilman Thomas Geisler. Mr. Geisler asked whether it is possible for
the Chautauqua Co. Legislature to levy a “surcharge” on property within Chaut.
Co. owned by out-of-state residents.
According to Mr. Spicer, only the New York State Legislature could adopt
such legislation.
Town Clerk Erlandson read the
following items into the record:
1.
Letter
from Sue Seamans, Director, Falconer Public Library thanking the
Ellicott Town Council for its annual contribution to the library.
2.
Notification
re the annual Southern Tier West Local Government Conference to be held
at Houghton College on May 18, 2006.
3.
Newsletter:
Chautauqua Co. Chamber of Commerce.
4.
Newsletter:
Chaut. Watershed Conservancy.
5.
Newsletter:
Manufacturers Association of the Southern Tier.
TOWN OFFICERS’ REPORTS
Councilman Geisler reported that he &
Councilman Heintzelman would be meeting with Town of Ellicott employees &
the Town’s health insurance brokers on March 29, 2006 to discuss employee
health insurance issues. He noted that
more meetings would be conducted periodically throughout the year.
Mr. Shellhouse also reported that the Town
recently received requests for municipal water & sewer service from 2
property owners on So. Work St. Ext.
& So. Dow St. He stated that
he has discussed the feasibility of the request with each property owner.
Mr. Shellhouse also reported that the
installation of new boilers at the water tower has resulted in significantly
reduced monthly gas bills for the tower.

Water Pump Station on School
Ave. –
Highway Superintendent Shellhouse reported that Tolman Engineering PLLC
has begun the design phase for the construction of a water pump station
in the Howard Ave. - School Ave. area (Minutes 3/6/06). Mr. Shellhouse also reported that a survey
would need to be conducted in conjunction with the project. He recommended that the Town Council retain
Town of Ellicott Code Enforcement Officer Randy Woodbury to conduct the
survey. He pointed out that utilizing
Mr. Woodbury would cost considerably less than retaining a surveying
company. The Council discussed the
matter.
Retain Surveyor (Randy
Woodbury)
Motion by Supervisor Tyler,
seconded by Councilman Pickett to retain Town of Ellicott Code
Enforcement Officer Randy Woodbury as a surveyor for the Town of Ellicott for
special projects at a cost to be determined.
Dog Control Ordinance (Proposed) –
The Town Council discussed a proposed dog control ordinance (Minutes
3/6/06). Tabled pending further
review.
Chautauqua Lake Local
Waterfront Revitalization Program (LWRP) - Supervisor Tyler reported that he received a
draft of the Chautauqua Lake Local Waterfront Revitalization Program (LWRP). He reminded the Council that the Chaut. Co.
Planning Dept. prepared the draft, under the guidance of the Town of Chautauqua
(Minutes 9/19/05). He explained
that before the draft can be submitted to the New York State Dept. of State it
must be submitted for public review. To
commence the public review phase the Ellicott Town Council & the eight (8)
other municipalities bordering Chautauqua Lake must accept the
draft. Mr. Tyler recommended that the
Council accept the draft at the April 6, 2006 Town Council meeting.
NEW BUSINESS
Motion by Supervisor Tyler,
seconded by Councilman Heintzelman to cancel the Regular Town Council meeting
scheduled for April 17, 2006 due to lack of a quorum.
Appoint Human Resources
Committee
– Supervisor Tyler appointed Councilmen Geisler & Heintzelman to meet with
department heads to review Town policies & personnel matters.
RESOLUTION #44-06
Authorize Bids for Highway
Materials and Services
Motion by Supervisor Tyler,
seconded by Councilman Pickett authorizing the Town of Ellicott Highway
Superintendent to solicit bids for highway
materials and services; bids to be returned no later than April 3, 2006 at 10:00 AM.

Budget Transfers
Motion by Supervisor Tyler,
seconded by Councilman Miller authorizing Town of Ellicott Supervisor to make
the following budget transfer:
Transfer the amount of $129.34 from Account #A1990.4 (Contingency) to Account #A1450.1 (Elections – Personal Services).

Payment of Claims
Motion by Supervisor Tyler, seconded by Heintzelman to pay 2006 current
claims #279-342, inclusive, in the amount of $90,811.82 and charge to the
proper fund or account.

Executive Session
(Personnel)
Motion by Supervisor Tyler, seconded by Heintzelman to convene Executive
Session for the purpose of discussing a personnel matter. 7:27 PM – 7:42 PM.
