Town Council of the Town of= Ellicott

held at = the Administration Building,

215 S. Work Street, Falconer, N.Y. on

February= 25, 2008 at 6:00 P.M.

 

Present: Supervisor Miller, Councilman Orlando= , Councilman Beckerink, Councilman Lodestro, Councilman Heintzelman, Deputy Town Clerk Pierce, Highway Superintendent Shellhouse, Attorney Wright, Code Enforcement Officer Woodbury.

 

Absent: Town Clerk Erlandson.

 

Supervisor Miller open= ed the meeting at 6:00 PM and led the Town Council in the Pledge of Allegiance.    Deputy Town Clerk Pierce called the roll. 

 

APPROVAL OF MINUTES

 

MOTION by Councilman Heintzelman, seconded by Councilman Orlando to accept the min= utes of the February 4, 2008 meeting as presented by the Town Clerk.<= /span>

PUBLIC HEARING (Increase Income Limits for Sr. Citizen Tax Exemptions)

 

Supervisor Miller open= ed a Public Hearing regarding a proposal to increase the income limits for tax exemptions for senior citizens.   No public comments were heard= .

 

MOTION by Councilman Lodestro, seconded by Councilman Beckerink to close the Public Hearing.

Supervisor Miller opened a Public Hearing on proposed Local Law #2-2008 regarding tax exemptions for persons with disabilities & limited incomes.  No public comments were heard.

 

MOTION by Councilman Heintzel= man, seconded by Councilman Orlando to close the Public Hearing.

PUBLIC HEARING (Local Law #3-2008: Rezoning on D= unham Ave.)

 

Supervisor Miller open= ed a Public Hearing re proposed Local Law #3-2008 regarding the rezoning of a section of Dunham Ave. from ‘residential’ to ‘neighborhood business’.&n= bsp; Mr. Richard Benedetto, = the owner of the property, stated that he plans to construct an office building= on the site.  The Town Council as= ked a number of questions re the matter.  <= /span>No public comments were heard.

TOWN OFFICERS’ REPORTS

 

Counc= ilman Lodestro reminded the Town Co= uncil that the Chaut. Co. Conference of M= ayors & Supervisors will be conducting its annual Legislative Breakfast on March 8, 2008 at 9:00 AM at the Lakewood American Legion Post in Lakewood, NY.

 

Councilman Orlando reported that he & Councilman Beckerink met recently with the To= wn of Ellicott Assessor.  He noted that the part-time cleric= al position in the Assessing office has not been filled.  The Council authorized the Assesso= r to advertise for the position in the J= amestown Post-Journal.=

RESOLUTION #36-08

Increase Senior Citize= n Tax Exemption

 

MOTION by Councilman Lodestro, seconded by Councilman Heintzelman that the qualifying limits for the senior citizen property tax exemption (Article 46= 7 of the Real Property Tax Law) be increased to $16,000.00 effective as of the n= ext taxable status date (March 1, 2008), with the income limit to be increased annually by an additional $1,000.00 per year in each of the next four (4) y= ears thereafter.  (see ‘Asses= sing – Sr. Citizen Tax Exemption’ file for detail)=

Local Law #2-2008: Tax Exemptions for Persons w/ Disabilities & Limited Incomes – The Town Council discussed the implications of adopting a proposed local law implementing a tax exemption for persons with disabilities and limited incomes.  Supervisor M= iller pointed out that, at the present time, the effect of the exemption on the Town’s tax levy is unknown.  The Council decided not to take any action on the local law at the present time.

Local Law #3-2008: Rezoning of Property on Dunha= m Ave.<= span style=3D'font-size:12.0pt;mso-bidi-font-weight:bold;mso-bidi-font-style:ita= lic'>The Town Council discussed a proposed local law to rezone a section of property= on the east side of Dunham Ave.  (Minutes 10/29/07 et. seq.)  <= /span>Supervisor Miller note= d that the Council received a letter from the Ellicott Planning Board in support of the proposed rezoning request.  However, Attorney Wright noted that the Ellicott Planning Board also recommended that the rezoning be subject to environmental review with the Planning Board acting as lead agency.  Therefore, he suggested that the Council not rezone the property unt= il the NY State Environmental Quality Review (SEQR) process has been completed= .  Tabled pending completion of SEQR process.

 

Easement Request from Sacred Heart Church & Real Estate Advantage – Attorney Wrig= ht stated that he has prepared easement agreements with Real Estate Advantage, 800 Fairmount Ave. & Sacred Heart Church, Lakewood,= NY for the use of unopened sections of First and Second Streets in the= Town of Ellicott.  (Minutes 1/21/08 et. seq.)  He briefly outlined the details of= the agreements.

Re-appointment to Boar= d of Assessment Review (Lloyd) – Supervisor Miller reported that Jean Lloyd’s term on the Ellicott = Board of Assessment Review has expired.  The Town Council directed Town Clerk Erlandson to contact Mrs. Lloyd= to determine whether she would be interested in serving another term.  Tabled until the March 3, 2008 mee= ting.
