Minutes of a Regular Meeting of the

Town Council of the Town of= Ellicott

held at = the Administration Building,

215 S. Work Street, Falconer, N.Y. on

February= 4, 2008 at 7:00 P.M.

 

Present: Supervisor Miller, Councilman Orlando, Councilman Beckerink, Councilman Lodestro, Councilman Heintzelman, Town Cle= rk Erlandson, Highway Superintendent Shellhouse, Attorney Wright, Code Enforce= ment Officer Woodbury, Legislators Barmore & Huckno.

 

Supervisor Miller open= ed the meeting at 7:00 PM and led the Town Council in the Pledge of Allegiance.    Town Clerk Erlandson called t= he roll. 

 

APPROVAL OF MINUTES

 

MOTION by Councilman Heintzelman, seconded by Councilman Lodestro to accept the minutes of the January 21, 2008 meeting as presented by the Town Clerk.

TOWN OFFICERS’ REPORTS

 

Counc= ilman Lodestro reported that the El= licott Facilities Committee & the Ellicott Public Safety Committee would be meeting later this month.

 

Counc= ilman Heintzelman reported that he = and Supervisor Miller met earlier this evening with Krystal Waite from Verac= ity Benefits.  He explained th= at Veracity is the Town’s new health insurance broker.  Mr. Heintzelman feels that the com= pany will do a good job representing the Town.

 

Mr. Heintzelman also asked if Town Board minutes are being posted to the Town of Ellicott website.  Town Clerk Erlandson stated that t= he minutes are being posted.

Counc= ilman Beckerink reported that the Ellicott Assessing Committee met recently.  He st= ated that the committee discussed the difficulty the Town Assessor has had in regards to hiring a part-time clerical employee in the assessing office.  He explained that Town Assessor Ma= rsha Painter has interviewed a number of candidates but no one has been interest= ed in the job.  According to Mr. Beckerink, Mrs. Painter feels that prospective candidates are not interested because the position only pays $8.00 per hour.  She has requested that the rate be raised to $10.00 per hr.  The Council discussed the matter.  Mrs. Painter will be asked to attend the March 3, 2008 Town Council meeting to e= xpress her concerns and answer questions re the clerical position.

Mr. B= eckerink also reported that the Ellico= tt Budget Committee would meet in March 2008.

 

Councilman Orlando reported that there will be a meeting on Feb 5, 2008 re possible gra= nt funding to conduct a “demonstration project” in conjunction with the protection of the Chautauqua Lake Watershed.

Town Clerk Erlandson reported that the = Town Code has been converted to an electronic format.  He noted that the code can now be = viewed on the Town of Ellicott website.

 

Mr. Erlandson also reported that he is = close to selecting a new municipal accounting software system for the Town of Ellicott.  He is still looking into possible compatibility issues involving the new software.  He will make a final decision re t= he software later this week.

 

The Council granted Highway Superintendent Shellhouse permission to obtain price quotes for a new street sweeper.<= span style=3D'mso-spacerun:yes'> 

 

Supervisor Miller reported that the Town received it’s annual invoice for $150.00 from So. Tier West Region= al Planning & Development Board.  He stated that he is unfamiliar with the services provided by STW and w= ill ask a representative from the organization to attend a future Council meeti= ng to outline their services.

 

OLD BUSINESS

Easement Request from Sacred Heart Church & = Real Estate Advantage - The Town Council discussed two (2) easement requ= ests it recently received from Sacred Heart Church, Lakewood, NY & Real Estate Advantage, 800 Fairmount Ave. for the use of unopened sections of First and Second Streets in the Town of Ellicott.  (Minutes 1/21/08)  Attorney Wright will prepare an easement agreement.

 

= Code Change (Industrial Parks) ̵= 1; Town Clerk Erlandson reported that a letter has been sent to the Planning B= oard requesting they review Section 146-42 of the Town of Ellicott Code concerni= ng permitted uses in Industrial Parks.  (Minutes 1/21/08)  Tabl= ed pending further review.

 

NEW BUSINESS

The Town Council scheduled a Special Meeting for Monday February 25, 2008 at 7:00.

 

Rezoning Request (Dunh= am Ave.) – The Town Council discussed a request to rezone a section of property on the east side of Dunham Ave. between Fairmount Ave. & the Village of Celoron from ‘residentialR= 17; to ‘neighborhood business’.  (Minutes 10/29/07)  Supervisor Miller noted that the C= ouncil received a letter from the Ellicott Planning Board in support of the propos= ed rezoning request.

 

MOTION by Supervisor Miller, seconded by Councilman Heintzelman to schedul= e a Public Hearing for Monday, February 25, 2008 at 7:00 PM regarding introduct= ory Town of Ellicott Local Law #3-2008 rezoning property on t= he east side of Dunham Ave. in the Town of Ellicott from ‘residential= 217; to ‘neighborhood business’.

Access Rd. at Southwes= tern Central School – The Town Council discussed a proposal by the Southweste= rn Central School Board to provide access from the Elementary School parki= ng lot onto Allegheny Ave.  Super= visor Miller noted that, at present, there is no access from the parking lot onto Allegheny Ave.  Currently, the parking lot can only be accessed via Hunt Rd.  The Council expressed concerns re = the proposal.  Councilman Heintzel= man feels that the proposal needs to be presented to the public - particularly = the residents of Allegheny Ave.  Attorney Wright feels that the school’s proposal is a breach o= f a 1999 agreement with the Town of Ellicott.&= nbsp; The Council will request the SWCS Superintendent to attend the March 3, 2008 meeting to outline the proposal in further detail.=

Tax Exemptions for Sen= ior Citizens and Persons w/ Limited Income – The Town Council discussed increasing the income limits for tax exemptions for senior citizens.  If adopted, the income limit would= be increased from $14,000.00 to $16,000.00 in 2009 and increased annually by $1,000.00 per year in each of the subsequent four years.  In addition, the Council discussed adopting a tax exemption for persons with disabilities & limited incomes.  Supervisor Miller po= inted out that both exemptions would have to be adopted before March 1, 2008 in o= rder to be effective for the 2009 fiscal year.&= nbsp; A Public Hearing would be necessary as well.

MOTION by Councilman Lodestro, seconded by Supervisor Miller to schedule a= Public Hearing for Monday, February 25, 2008 at 7:00 PM regarding introduct= ory Town of Ellicott Local Law #2-2008 to provide a tax exemptio= n for persons with disabilities and limited incomes.
