January 3,
2001 at 6:30 P.M.
Present: Supervisor Tyler, Councilman Hendrickson, Councilman Lodestro, Councilman Miller, Councilman Taylor, Town Clerk Erlandson, Highway Superintendent Shellhouse, Code Enforcement Officer Woodbury, Attorney Duncanson, Legislator Spicer.
Supervisor Tyler opened the
meeting at 6:30. Town Clerk Erlandson
called the roll.
RESOLUTION #1-01
Convene Executive Session (Possible Litigation)
Motion
by Supervisor Tyler, seconded by Councilman Hendrickson to Convene Executive Session for the purpose of discussing possible litigation. 6:30 – 7:00 PM

Supervisor Tyler opened the Regular
meeting at 7:00 and led the Town Council in the Pledge of Allegiance. Town
Clerk Erlandson called the roll.
PUBLIC
HEARING (Proposed Local Law #1-01: Amend Stormwater/Illumination Code)
Supervisor Tyler opened a Public Hearing on proposed
Local Law #1-01 amending the Town of
Ellicott Code re storm-water management & illumination. No
public comments were heard.
Motion by Supervisor Tyler, seconded by Councilman Miller to close the Public Hearing at 7:02 PM.
Motion
by Councilman Lodestro, seconded by Councilman Miller to accept the minutes of
the December 20, 2000 meeting as presented by the Town Clerk.
PRIVILEGE OF THE FLOOR
Ms. Helen Sischo, 2601 S. Work St., expressed dissatisfaction with the Town Council re
the recent change in Town Attorneys (see ‘Resolution #175-00’). In her opinion, the matter was poorly
handled.
Town Clerk Erlandson read the
following items into the record:

TOWN OFFICERS’ REPORTS
Town Clerk Erlandson reported that he and Councilman Hendrickson will meet with department heads in the next several days to review price quotes for a new copy machine.
On the advice of Councilman Hendrickson, the Town Council formed an Information Services Committee consisting of the following individuals: Councilman Hendrickson, Councilman Miller, Town Clerk Erlandson, Highway Superintendent Shellhouse, Police Chief Vanstrom, Code Enforcement Officer Woodbury, Network Administrator Matthew Kubinski.
Highway Superintendent Shellhouse reported that the Jamestown Board of Public Utilities will be installing water and sewer lines along So. Dow St. to service the new Schwan’s Fine Foods facility.
Code Enforcement Officer Woodbury reported that he recently attended an Airport Commission meeting. He noted that a new restaurant will be opening at the Chaut. Co. Airport on Jan. 15, 2001.

designating the Jamestown Post-Journal as the official newspaper of the Town of
Ellicott.
RESOLUTION #3-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
designating the first and third
Wednesdays at 7:00 P.M. each
month as the Regular Meeting times
of the Ellicott Town Council.
RESOLUTION #4-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
appointing Patrick A. Tyler as Budget
Officer for the Town of Ellicott for 2001 at a salary of $1,650.00.
RESOLUTION #5-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
setting the salaries of the Town of Ellicott elected officials for 2001 as follows:

RESOLUTION #9-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
to adopt the Town of Ellicott Investment
Policy.
RESOLUTION #10-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
authorizing the Town Supervisor to invest monies in time accounts, open accounts, CDs, and money-market accounts at M
& T Bank, Marine Midland Bank, Fleet Bank, Key Bank, Integra Bank and
any new banks.
RESOLUTION #11-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
to set the salary of the Ellicott Building
Inspector/Code Enforcement Officer at $36,000.00 for 2001.
RESOLUTION #12-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
establishing the rate of pay for
Town of Ellicott Election Inspectors
at $6.25 per hour for 2001.
RESOLUTION #13-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
establishing the rate of pay for
Town of Ellicott Voting Machine
Custodians at $40.00 per machine for 2001, including recanvassing.

appointing Larry Belin as Town of
Ellicott Dog Control Officer for
2001 at an annual salary of $2,900.00 plus $50.00 per month for mileage.
RESOLUTION #15-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
authorizing the Town of Ellicott Justices to employ a court stenographer when
required at $75.00 per appearance.
RESOLUTION #16-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
establishing the current IRS mileage
allowance rate to be paid to Town of Ellicott employees using their
personal vehicles for approved Town
of Ellicott purposes.
RESOLUTION #17-01 - Motion by Supervisor Tyler, seconded by Councilman Lodestro
authorizing all Town of Ellicott elected officials, Planning and Zoning Board
members, Code Enforcement Officer, Town Attorney and Town Assessor to attend
the Association of Towns meeting in
February 2001 in New York City if approved by the Town Council, provided monies are available in the
budget for that purpose or at their own expense.

setting the salary for Town of Ellicott Receiver
of Taxes Michael C. Erlandson at $5,693.00 for 2001.

the Town of Ellicott of $5,150.00 for 2001.

RESOLUTION
#27-01
Adopt Local
Law #1-2001 (Amend Code: Stormwater Management/Illumination)
Motion by Councilman Hendrickson, seconded by Supervisor Taylor to adopt Town of Ellicott Local Law #1-2001 amending the Town of Ellicott code pertaining to Stormwater Management and Illumination. (see ‘Local Law #1-2001’ for detail)
Buffalo-Willard Water Service – Highway Superintendent Shellhouse reported that construction of the new water line in the Buffalo St. Ext. – Willard St. Ext. area is scheduled to begin next week. Supervisor Tyler reported that funding for the project will be available on Jan. 26, 2001.
NEW BUSINESS
Vacancy on Zoning Board of
Appeals (Martinelli) – Supervisor Tyler reported that the recent appointee to the Zoning
Board of Appeals, Susan Martinelli, declined the appointment.
RESOLUTION #28-01
Appointment to Zoning Board of Appeals (Hoglin)
Motion by Councilman Taylor, seconded by Councilman Hendrickson to appoint Steven Hoglin, 3244 Moon Road, to fill an unexpired term on the Ellicott Zoning Board of Appeals, effective January 1, 2001; term to expire December 31, 2001.

Re-appointment to Zoning Board of Appeals (Saff)
Motion by Councilman Taylor, seconded by Councilman Hendrickson to appoint Kevin Saff 2261 Swanson Road, to a new five-year term on the Ellicott Zoning Board of Appeals, effective January 1, 2001; term to expire December 31, 2005.
RESOLUTION #30-01
Retain Attorney (SEQR For Route 60 Rezoning)
Motion by Supervisor Tyler seconded by Councilman Hendrickson to retain the firm of Wright, Wright and Hampton to conduct a State Environmental Quality Review (SEQR) for the rezoning of a section of Route 60. (see ‘Route 60 Rezoning’ file for detail)
RESOLUTION #31-01
Budget Appropriation
Motion by Supervisor Tyler, seconded by Councilman Hendrickson authorizing
Town of Ellicott Supervisor to make the following budget transfer:
Appropriate the amount of $4,123.15 to Account #A1620.2 (Buildings – Equipment).
RESOLUTION #32-01
Payment of Claims
Motion by Supervisor Tyler, seconded by Councilman Taylor to pay 2000 current claims #1491-1529,
inclusive, in the amount of $17,057.64 and charge to the proper fund or
account; and, further, to pay 2001
current claims #1-10, inclusive, in the amount of $12,078.97 and charge to
the proper fund or account.
